4 <br /> THE CITY OF <br /> pL£ ASANTONe CITY COUNCIL AGENDA REPORT <br /> May 4, 2010 <br /> Community Development <br /> Engineering Division <br /> TITLE: ADOPT RESOLUTION INITIATING FORMATION OF UNDERGROUND <br /> UTILITY DISTRICT NO. 09 -01, AND SETTING A PUBLIC HEARING <br /> SUMMARY <br /> On October 20, 2009, Council directed staff to initiate formal proceedings to form <br /> Underground Utility District UUD -09 -01 for Stanley Boulevard. Establishment of the <br /> UUD is required by PG &E to participate in the design of the District. Although the <br /> District will be formed, the City is not obligated to complete project construction. Staff <br /> anticipates they will report back to the City Council with bid results prior to a decision <br /> being made relative to the Stanley Boulevard Improvement project and the Utility <br /> Undergrounding project. In order to conduct a public hearing on the formation of the <br /> District, the City is required to adopt a resolution a minimum of thirty (30) days in <br /> advance. <br /> RECOMMENDATION <br /> 1. Adopt a resolution setting June 15, 2010, at the hour of 7:00 p.m. in the Council <br /> Chambers, as the time and place of a public hearing on the formation of <br /> Underground Utility District No. 09 -01, Stanley Boulevard from Santa Rita Road <br /> to First Street. <br /> 2. Direct the City Clerk to mail notices of the public hearing to all affected property <br /> owners and utility companies. <br /> FINANCIAL STATEMENT <br /> The underground utility district improvements, once accepted by the public utility <br /> companies, will be operated and maintained by the respective utility companies and <br /> have no financial impact on City maintenance and operation costs. <br />
