RESOLUTION NO. 10 -354 <br /> RESOLUTION APPROVING THE 2010 WEED ABATEMENT PROGRAM AND <br /> AUTHORIZING THE ABATEMENT OF WEEDS, DIRT, RUBBISH OR REFUSE UPON <br /> OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF <br /> PLEASANTON <br /> WHEREAS, at its meeting of March 16, 2010, Council adopted Resolution No. 10 -345 <br /> declaring as a public nuisance all weeds, dirt, rubbish or refuse upon or in front of certain <br /> described properties within the City of Pleasanton as more particularly set forth in Exhibit "A <br /> attached hereto; and <br /> WHEREAS, Resolution No. 10 -345 was adopted pursuant to the provisions of <br /> Government Code Sections 39560- 39588; and <br /> WHEREAS, Resolution No. 10 -345 designated April 20, 2010, at the hour of 7:00 p.m., <br /> as the time, date and place to hear and consider objections to the abatement and removal of <br /> weeds, rubbish or refuse upon or in front of certain described properties within the City of <br /> Pleasanton; and <br /> WHEREAS, the Fire Department was charged with the responsibility to perform the <br /> duties imposed by Government Code Sections 39560- 39588, and did prepare notices to destroy <br /> weeds and remove rubbish and refuse; and <br /> WHEREAS, the Fire Department, in accordance with Government Code Section <br /> 39567.1, did mail written notice of the proposed abatement and removal and the public hearing <br /> to all persons owning property described in Exhibit A; and <br /> WHEREAS, the City Council did hold a public hearing on April 20, 2010 and no protests <br /> were presented; and <br /> WHEREAS, abatement of the nuisance may be performed by the City or by a contractor; <br /> and <br /> WHEREAS, before the weeds are abated by the City or a contractor, any property owner <br /> may remove the weeds, rubbish or refuse at the property owner's own expense. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The Fire Inspector is ordered to abate the nuisance declared by Resolution <br /> No. 10 -345 by causing the weeds, dirt, rubbish and refuse to be removed by the City or a <br /> contractor awarded the work by the City for the removal of weeds, rubbish or refuse, and for this <br /> purpose, the Fire Inspector (and /or the Fire Inspector's designee) and /or the contractor may <br /> enter upon private property to abate the nuisance. Before the weeds are abated by the City or a <br /> contractor, any property owner may remove the weeds, rubbish or refuse at the property <br /> owner's own expense. <br />
