SECTION 5. The name of the district shall remain the Tri- Valley Tourism Business <br /> Improvement District. <br /> SECTION 6. The TVCVB proposes to administer marketing programs to promote the Tri <br /> Valley area as a tourism destination and to fund projects, programs, and activities that benefit <br /> lodging businesses within the boundaries of the District. <br /> SECTION 7. Assessment rates are a flat $2.00 per occupied room per night on short <br /> term (stays less than 31 days) stays in lodging businesses. This assessment shall not increase <br /> in years one through three. In years four and five, the assessment may be increased annually <br /> up to an additional ten cents ($0.10) per occupied room per night upon a majority vote of the <br /> TVCVB Board of Directors. Based on the benefit received, assessments will not be collected on <br /> stays of more than thirty (30) consecutive days, nor on stays by government employees on <br /> government business. Assessments pursuant to the TVTBID shall not include room rental <br /> revenue resulting from stays pursuant to contracts executed prior to adoption of the Ordinance <br /> renewing the TVTBID. <br /> SECTION 8. Each city and town shall be responsible for collecting the assessments <br /> from the lodging businesses within their respective jurisdiction. All lodging businesses available <br /> to the public with thirty -five rooms or more, including new lodging businesses which open during <br /> the term of the district, shall be subject to the assessment. Assessments pursuant to the <br /> TVTBID shall not be included in gross room rental revenue for purposes of determining the <br /> amount of transient occupancy tax. <br /> SECTION 9. The TVTBID will have a five -year term. <br /> SECTION 10. It is estimated that the total annual assessments will be $1,520,000. The <br /> assessments levied for the TVTBID shall be applied towards marketing and promotions to <br /> increase tourism and market the Tri Valley area as a tourist, meeting, and event destination. <br /> Funds remaining at the end of any year may be used in subsequent years in which TVTBID <br /> assessments are levied as long as they are used consistent with the requirements of this <br /> Resolution. If the term of the TVTBID is not extended beyond five years (or if the term of the <br /> TVTBID is less than five years) and there are funds remaining at the end of the term, such funds <br /> may be used for purposes consistent with the requirements of this Resolution. <br /> SECTION 11. The cities of Livermore, Dublin, and San Ramon and the town of Danville <br /> shall transmit their collected assessments to the City of Pleasanton which shall administer the <br /> funds collected. <br /> SECTION 12. No bonds will be issued for the TVTBID. <br /> SECTION 13. The time and place for the first public hearing and introduction of the <br /> ordinance to renew the TVTBID and the levy of assessments are set for June 1, 2010, at 7:00 <br /> p.m., or as soon thereafter as the matter may be heard, at the Council Chambers located at 200 <br /> Old Bernal Avenue, Pleasanton, CA 94566. <br /> SECTION 14. The time and place for the public hearing and second reading and <br /> adoption of the ordinance to renew the TVTBID and the levy of the assessments are set for <br /> June 15, 2010 at 7:00 p.m. at the City of Pleasanton City Council Chambers, 200 Old Bernal <br /> Avenue, Pleasanton, California. The Pleasanton City Clerk is to provide written notice to the <br /> lodging businesses of the date and time of the public hearings. <br />
