RESOLUTION NO. 10 -352 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DECLARING ITS INTENTION TO RENEW THE TRI- VALLEY TOURISM BUSINESS IMPROVEMENT DISTRICT (TVTBID) AND FIXING THE TIME AND PLACE OF PUBLIC HEARINGS THEREON AND GIVING NOTICE THEREOF WHEREAS, the Tri- Valley Convention Visitors Bureau (TVCVB) is interested in renewing the Tri Valley Tourism Business Improvement District (TVTBID) and levying an assessment on certain lodging businesses within the proposed renewed TVTBID, and WHEREAS, the Property and Business Improvement District Law of 1994, California Streets and Highways Code Section 36600 et seq., authorizes cities to establish property and business improvement districts for the purpose of promoting tourism, and WHEREAS, the cities of Livermore, Dublin and San Ramon, and the town of Danville, have consented to the Pleasanton City Council renewing the TVTBID, and WHEREAS, the TVCVB has drafted a Management District Plan which sets forth the proposed boundary of the TVTBID, a service plan and budget, and a proposed means of governance, and WHEREAS, a majority of the lodging business owners subject to assessment under the TVTBID have petitioned the City Council to renew the TVTBID, and WHEREAS, the cities of Pleasanton, Livermore, Dublin, and San Ramon, and the town of Danville desire to have the TVCVB manage the activities provided by the proposed TVTBID. NOW, THEREFORE, the City Council of the City of Pleasanton does hereby resolve, determine and find as follows: SECTION 1. The recitals set forth herein are true and correct. SECTION 2. The City Council finds that the lodging businesses that will pay more than 50% of the assessment proposed in the Management District Plan have signed petitions in support of the renewal of the TVTBID. The City Council accepts the petitions and adopts this Resolution of Intention to renew the TVTBID and to levy an assessment on certain lodging businesses within the TVTBID boundaries in accordance with the Property and Business Improvement District Law of 1994. SECTION 3. The City Council finds that the Management District Plan satisfies all requirements of Streets and Highway Code sections 36622 and 36660. SECTION 4. The City Council declares its intention to renew the Tri Valley Tourism Business Improvement District and to levy and collect assessments within the TVTBID boundaries pursuant to the Property and Business Improvement District Law of 1994, California Streets and Highways Code Section 36600 et seq. The boundaries of the TVTBID shall be the cities of Pleasanton, Livermore, Dublin, and San Ramon, and the town of Danville as illustrated on the attached map (Exhibit A). The TVTBID shall include all lodging businesses located within these boundaries with 35 rooms or more that are available to the public.
