Councilmember Sullivan inquired about the cost of the November election if it did not include <br /> this item. Mr. Fialho referred to the staff report, which specifically states a cost of $79,000. <br /> Councilmember Sullivan asked and Mr. Fialho confirmed that would be the cost whether this <br /> item is included or not. Ms. Diaz noted that the only additional cost would be printing the <br /> Ordinance text. <br /> Councilmember McGovern said she supports the community in its position against ridgeline <br /> development and its request that the developer return with a project that includes a park and <br /> meets the significant requirements of Measures PP and QQ. <br /> MOTION: It was m/s by McGovern /Sullivan to repeal Ordinance No. 1961. <br /> Councilmember Sullivan said this project, which he initially supported, has transcended the <br /> issue of hillside development and is now about the public process, disclosure of information, <br /> and democracy. He said the fact that two Councilmembers are not allowed the time to obtain <br /> the information they need indicates a serious problem with the public process and democracy in <br /> this City. He said he has been involved in every referendum initiative effort in Pleasanton over <br /> the last 15 years and witnessed the harassing tactics using by the developer of the Ponderosa <br /> project. He said it was fortunate that Council understood the issue and rescinded the project, <br /> sending the message to the developer that public process and the people's constitutional right <br /> to overturn their City Council is more important than a housing project. <br /> Mayor Hosterman cited the 1990 referendum concerning a similar project. <br /> Vice -Mayor Thorne said he could not support the request to repeal. He said he was not <br /> convinced that that those who signed the petition and who voted in favor of Measures PP and <br /> QQ would vote to uphold the referendum. <br /> Councilmember Cook Kallio said her goal has always been to try and balance the needs of the <br /> community. She acknowledged that some would like the Council to see things in black and <br /> white, which is impossible. <br /> Councilmember McGovern recommended that voters review the public record for this project. <br /> MOTION failed by the following vote: <br /> Ayes: Councilmembers McGovern, Sullivan <br /> Noes: Councilmembers Cook Kallio, Thorne, Mayor Hosterman <br /> Absent: None <br /> MOTION: It was m/s by Cook- Kallio/Thorne to submit Ordinance No. 1961 to the voters. Motion <br /> passed by the following vote: <br /> Ayes: Councilmembers Cook Kallio, Thorne, Mayor Hosterman <br /> Noes: Councilmembers McGovern, Sullivan <br /> Absent: None <br /> MOTION: It was m/s by McGovern /Sullivan to place Ordinance No. 1961 on the November 2, <br /> 2010 ballot. <br /> City Council Minutes Page 7 of 15 February 16, 2010 <br />
