All terms and conditions of Use Permit-68-6, to the extent still applicable, shall
remain in full force and effect.
4. The final parcel map shall be recorded within two years of the date of this
approval, as that date may be extended by law or otherwise, or this approval
shall lapse. The condominium plan and CC&R's, however, shall not be recorded
for at least ten years from the time the final parcel map records and the property
owner shall not sell any of the individual units for at least ten years from the date
the final parcel map records. The 208 condominium units covered by this approval shall be subject to a
property owners' association through CC&R's to establish powers and
responsibilities for the ownership, use and maintenance of common areas and
facilities within the project, including, but not limited to, storm drainage, parking,
access, utilities and landscaping. After the CC&R's have been approved by the
State Department of Real Estate and prior to the recordation of the condominium
plan, the CC&R's shall be submitted to the City Attorney for review and approval,
which approval shall not be unreasonably withheld. The City Attorney's
disapproval shall be deemed reasonable only if, among other things, the issue or
determination upon which the disapproval is based is not preempted by State
law.
