<br />of any building permits on the subject property the <br />developer shall enter into an agreement with the City <br />agreeing to pay for the studies and provide the mitigation <br />measures when deemed necessary by the City Engineer. <br />Assessment districts shall be used to fund construction of <br />these noise mitigating facilities wherever found appropriate <br />and the cost spread to properties within the districts. <br /> <br />6. That building and parking minimum setbacks shall be as set <br />forth in the Hacienda Business Park Design Guidelines <br />dated 9/14/83 and the Hacienda Business Park CC&Rs, <br />attached hereto and made part of this case by reference. <br /> <br />7. That the Design Guidelines shall be used as a guide for <br />the landscaping of the Hopyard Road public service easement <br />and median strip, but final approval of the landscaping <br />of those two areas shall rest with the City staff. <br /> <br />8. That the Design Guidelines shall be used as a guide for the <br />landscaping of the 33 ft. to 50 ft. with public service <br />. easements along interior project roads, but final approval <br />of the landscaping of these areas shall take place as part <br />of the design consideration by the City. <br /> <br />9. That the Design Guidelines shall be used as a guide for <br />the landscaping and design of the site parking areas and <br />side and rear yard areas, but final approval of the land- <br />scaping and design of these areas shall take place <br />as part of the design consideration by the City. <br /> <br />10. That all signing for the project shall be submitted to <br />the City for approval. The Design Guidelines shall be <br />used as a guide for such signing. <br /> <br />11. That where enumerated conditions of this PUD report conflict <br />with statements in the PUD development plan, Design Guidelines <br />and CC&Rs, the former shall control, except that developer <br />may impose more restrictive conditions. <br /> <br />12. That the developer realize that the development plan, Design <br />Guidelines and CC&Rs are only guides to the development of <br />the subject property and that where statements, tables, figures <br />and other data within these documents conflict with City <br />procedures, policies and codes, the City's procedures, <br />policies and codes shall govern, except that the developer may <br />impose more restrictive procedures and standards. <br /> <br />13. That Table B-1 of the CC&Rs shall be used as a guide for <br />parking within the Hacienda Business Park, but that final <br />approval of parking required shall be determined at the <br />time of design review by the City. <br />
