• No wires, signs, or ropes may be attached to any tree that is part of this <br />development including the permanent open space area. <br />54. At the discretion of the Planning Director, the information contained in the above- <br />described BOWMP and HTMP plans may be combined provided that the <br />information is clear and legible. <br />55. The project developer shall post cash, letter of credit, or other security satisfactory <br />to the Planning Director in the amount of the valuation of each tree identified in <br />the HTMP should any work, utilities or otherwise, be conducted within an area in <br />which potential impacts may be anticipated. This cash bond or security shall be <br />retained for two years following acceptance of public improvements or completion <br />of construction, whichever is later, and shall be forfeited if the trees are destroyed <br />or substantially damaged. In the event any trees are destroyed or substantially <br />damaged, an arborists' assessment, at the developer's expense, shall be required <br />to determine the value of the damage or loss and the resultant sum paid to the <br />City's Urban Forestry Fund or used for the suitable mitigation by planting <br />specimen trees on-site, as determined by the Planning Director. <br />56. A final landscape plan and temporary irrigation plan for the open space areas <br />surrounding the 51 lots covered by this development shall be submitted to and <br />approved by the City's Landscape Architect and the Planning Director as part of <br />the improvement plans prior to recordation of the final subdivision map. The <br />landscape plan shall be consistent with the "Oak Grove Open Space & Common <br />Area Design Guidelines", HTMP, and the BOWMP, plus the following conditions: <br />a. To compensate for the habitat values lost from the removal of blue oak <br />woodland, heritage-size, and non-heritage size trees due to the project's <br />development, the project developer shall replace these trees removed with <br />development, with a combination of `TreePot", 5-gallon, 15-gallon, and 24- <br />inch box-size native specimen trees at a ratio to be determined by the <br />Planning Director and the City Landscape Architect. <br />The project developer shall plant the replacement trees in the development's <br />open space areas with the first phase of subdivision construction, and shall <br />maintain, replace, and irrigate the replacement trees by a temporary irrigation <br />system as determined by the City Landscape Architect for five years after <br />installation and until the planting is accepted by the Director of Parks and <br />Community Services. (Mitigation Measure D-10 of the FEIR.) <br />b. The project developer shall install the temporary irrigation system after <br />grading is completed and with the first phase of the subdivision's construction. <br />The project developer shall maintain and repair the irrigation system for the <br />five-year time-period until the tree planting is accepted by the City when the <br />irrigation lines shall be abandoned and the water meters removed.
