properties as outlined and for the purposes of collecting litter, cigarettes, beverage containers <br /> and other items likely left by Redcoats' patrons. <br /> Vice -Mayor Thorne said there may have been misunderstanding regarding the basis of appeal <br /> and that it was never his intent to prevent the applicant from offering music during the hours <br /> requested. He said increased music and activity directly improves downtown vitality and that <br /> Redcoats has and will continue to be a valuable asset to the downtown area. He supported the <br /> additional conditions recommended by staff and suggested that an additional condition aimed at <br /> sound level monitoring could go a long way towards addressing the remaining issues and <br /> protecting the applicant. He said the greatest argument seems to pertain to sound levels and <br /> noted that noise differs from sound in that it is subjective. He suggested the applicant purchase <br /> an inexpensive sound meter with which to measure, record, and compare existing sound levels <br /> against accepted standards. He said the applicant should be sure the meter reads A -scale with <br /> a slow meter response and that he easily found 2 online sources offering a suitable meter for <br /> $50. He also recommended the Council consider a discussion on the need for a downtown area <br /> covenant of some kind to avoid these issues in the future. <br /> Councilmember Sullivan asked if it would be correct that in addition to smoking, a fair amount of <br /> drinking takes place outside as well. Mr. Dolan said it is subjective, but that outdoor drinking has <br /> been mentioned as an issue and that bottles and glasses have been found far afield from the <br /> restaurant. <br /> Councilmember Sullivan referred to the latest staff memorandum which contained statistics on <br /> police service calls in 2008 and 2009, said that 2009's 69 calls seems excessive, and asked <br /> how that compares to similar operations within the City. <br /> Captain, Dave Spitler, explained that some of the calls were officer initiated for service, <br /> including random patrol checks, bar checks, traffic stops, vehicle code violations, and other <br /> things of the sort. He noted that number increased from 7 in 2008 to 22 in 2009. <br /> Councilmember Cook- Kallio asked and Captain Spitler confirmed the patrols are not necessarily <br /> related to a problem or disturbance. <br /> Councilmember Sullivan asked how that compares to similar downtown establishments. Captain <br /> Spitler noted a distinction between Redcoats and those establishments which are purely <br /> restaurants and said this would most likely be on par. <br /> Councilmember Sullivan asked how code enforcement issues are handled, given that this sort <br /> of entertainment is not typically offered during normal business hours. Mr. Dolan confirmed that <br /> code enforcement officers do not typically work during evening or weekend hours, unless <br /> specifically arranged. He noted that the conditions do not propose a specific monitoring <br /> responsibility by the City and said that, like many conditions of approval, they would be enforced <br /> only in event of a complaint. He said in this instance, a portion of the burden would fall upon the <br /> police department. He said both the Police Department and Planning staff have identified the <br /> need for better coordination and education of officers on the conditions of approval for various <br /> establishments and that staff has been working proactively to rectify that. Officers are also being <br /> better educated in terms of noise requirements in the downtown area and how and when to use <br /> noise meters in response to a complaint and that the public must be better educated in terms of <br /> specifying their complaint pertains to noise. <br /> Councilmember Sullivan asked if Vice -Mayor Thorne would suggest the applicant purchase a <br /> noise meter, as well. Vice -Mayor Thorne confirmed, stating he believed it would be to the <br /> benefit of the applicant. He would like to see it as a condition of approval for anyone requesting <br /> City Council Minutes Page 4 of 9 February 2, 2010 <br />
