Commission for their subsequent review at a public hearing. If necessary, the <br /> Commission may modify or add conditions of approval to mitigate such impacts, <br /> or may revoke said conditional use permit. Possible mitigation measures can <br /> include, but are not limited to: modifying the hours of operation, prohibiting <br /> amplified music, hiring additional security personnel, or other measures deemed <br /> necessary by the Planning Commission. <br /> 8. Activities conducted on the subject property shall comply with Chapter 9.04 of the <br /> Pleasanton Municipal Code (Noise Regulations). The applicant (or designated <br /> representative of the business) shall ensure that all DJs performing on the <br /> subject property are aware of the City's noise regulations. <br /> 9. The business owner shall adhere to a "good neighbor" policy, meaning that the <br /> operator and employees must respect the rights of neighboring properties and, to <br /> the best of their ability, shall ensure their patrons' compliance with the City's <br /> noise and smoking regulations and any applicable conditions of approval for the <br /> subject business relating to parking location, smoking location, litter, noise, <br /> loitering, etc. <br /> 10. The business owner shall implement a nightly closing procedure each evening <br /> indoor music occurs that shall include the following: <br /> a. If approved by the relevant neighboring property owners, the operator <br /> shall perform an inspection with flashlight of the City street, sidewalks, <br /> entranceways, and landscaping in front of the surrounding properties for <br /> litter (including cigarettes), beverage containers (cans, bottles, glassware, <br /> etc.), vomit, and other items that were likely to have been left there by <br /> Redcoats patrons. <br /> b. The applicant (or designated representative) shall immediately clean up <br /> any litter (including cigarettes), beverage containers (cans, bottles, <br /> glassware, etc.), vomit, and other items that were likely to have been left <br /> by Redcoats patrons found on the City street, sidewalks, entranceways, <br /> and landscaping in front of the surrounding properties. <br /> For the purposes of this condition, the surrounding properties shall include: the <br /> south side of St. Mary Street between the eastern property line of 348 St. Mary <br /> Street (currently occupied by Fernando's Restaurant) and the eastern edge of <br /> the 312 St. Mary Street building (currently occupied by Al's Hair Design and <br /> Gene and Genie Finch); and the north side of St. Mary Street between the <br /> western property line of 351 St. Mary Street (currently occupied by Harris Real <br /> Estate Service, Inc. and Harris, Rosales, and Harris Attorneys at Law) and the <br /> eastern edge of the building at 327 St. Mary Street (currently occupied by Mike <br /> Carey Real Estate). <br /> 11. Except as noted above, all previous conditions of approval for Case PCUP -129 <br /> shall remain in full force and effect. <br /> (end) <br />
