11. <br /> <br />12. <br /> <br />13. <br /> <br />As stated in the applicants' narrative, appetizers or other acceptable food service shall be available <br />for patrons of the restaurant/bar during the operating hours of the business. <br /> <br />Except for outdoor dining areas, alcohol shall not be consumed outside the establishment. Alcohol <br />service and consumption on the decks is allowed only upon specific approval by the Department of <br />Alcoholic Beverage Control (ABC) and shall be subject to ABC requirements. The applicants are <br />responsible for supervising and controlling the activities of their customers within the outdoor <br />dining areas. The applicants shall ensure that no disorderly behavior occurs in these areas and that <br />drinks are not taken outside of the outdoor dining areas. The inability of the applicants to perform <br />in this manner shall be cause for review and revocation of this use permit as it pertains to the <br />service of alcoholic beverages in the outdoor dining areas. <br /> <br />The applicants shall obtain all necessary approvals from the Department of Alcoholic Beverage <br />Control (ABC) prior to occupancy. <br /> <br />The applicants shall contact the Building, Fire, Police, and County Environmental Health <br />Departments to determine all applicable requirements. The structure shall conform with all <br />applicable occupancy requirements, codes, and ordinances. All future tenant improvements shall <br />be included as part of this condition. <br /> <br />The outdoor deck area shall be closed at 11:00 p.m., Sunday through Thursday, and 12:00 a.m. <br />(midnight), Friday and Saturday. All music shall be performed inside the building and not on the <br />outdoor deck area. When music is being performed inside, the applicants shall keep the restaurant/ <br />bar doors closed. If amplified music is resumed after the mitigations are put in place, the patio <br />shall be used only for sit-down dining. <br /> <br />No smoking is allowed in the restaurant or in the outdoor dining area. <br /> <br />The applicants shall maintain the area surrounding the bar tenant space in a clean and orderly <br />manner at all times. The applicant shall be responsible for and shall monitor the area outside of the <br />restaurant/bar to ensure peace and quiet. <br /> <br />In the event that nuisances are created through the operation of the bar, either within the bar itself <br />or by. its patrons in the vicinity of the bar, the Planning Director may refer the conditional use <br />penmt to the Planning Commission for review at a public hearing. If necessary, the Planning <br />Commission may add additional conditions of approval or may revoke the conditional use permit. <br /> <br />If operation of this use results in conflicts pertaining to parking, noise, traffic, or other impacts, at <br />the discretion of the Planning Director, this conditional use permit may be referred to the Planning <br />Commission for subsequent review at a public heating. If necessary, the Commission may modify <br />or add conditions of approval to mitigate such impacts, or may revoke said conditional use permit. <br /> <br />All restaurant facilities shall be equipped at all times with filtering devices to minimize odors and <br />fumes. <br /> <br />SR: 03:004 <br />Page 11 of 12 <br /> <br /> <br />
