11. 12. 13. As stated in the applicants' narrative, appetizers or other acceptable food service shall be available for patrons of the restaurant/bar during the operating hours of the business. Except for outdoor dining areas, alcohol shall not be consumed outside the establishment. Alcohol service and consumption on the decks is allowed only upon specific approval by the Department of Alcoholic Beverage Control (ABC) and shall be subject to ABC requirements. The applicants are responsible for supervising and controlling the activities of their customers within the outdoor dining areas. The applicants shall ensure that no disorderly behavior occurs in these areas and that drinks are not taken outside of the outdoor dining areas. The inability of the applicants to perform in this manner shall be cause for review and revocation of this use permit as it pertains to the service of alcoholic beverages in the outdoor dining areas. The applicants shall obtain all necessary approvals from the Department of Alcoholic Beverage Control (ABC) prior to occupancy. The applicants shall contact the Building, Fire, Police, and County Environmental Health Departments to determine all applicable requirements. The structure shall conform with all applicable occupancy requirements, codes, and ordinances. All future tenant improvements shall be included as part of this condition. The outdoor deck area shall be closed at 11:00 p.m., Sunday through Thursday, and 12:00 a.m. (midnight), Friday and Saturday. All music shall be performed inside the building and not on the outdoor deck area. When music is being performed inside, the applicants shall keep the restaurant/ bar doors closed. If amplified music is resumed after the mitigations are put in place, the patio shall be used only for sit-down dining. No smoking is allowed in the restaurant or in the outdoor dining area. The applicants shall maintain the area surrounding the bar tenant space in a clean and orderly manner at all times. The applicant shall be responsible for and shall monitor the area outside of the restaurant/bar to ensure peace and quiet. In the event that nuisances are created through the operation of the bar, either within the bar itself or by. its patrons in the vicinity of the bar, the Planning Director may refer the conditional use penmt to the Planning Commission for review at a public hearing. If necessary, the Planning Commission may add additional conditions of approval or may revoke the conditional use permit. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this conditional use permit may be referred to the Planning Commission for subsequent review at a public heating. If necessary, the Commission may modify or add conditions of approval to mitigate such impacts, or may revoke said conditional use permit. All restaurant facilities shall be equipped at all times with filtering devices to minimize odors and fumes. SR: 03:004 Page 11 of 12
