She said she reads that as finite and that changing that language to allow for a minority and <br /> majority report as well as time extensions is not a finite goal. <br /> Councilmember Sullivan maintained his preference for 12 to 18 months, with a 12 month review. <br /> Councilmember Thorne proposed a 12 month goal, following an educational period of three <br /> months. <br /> Mayor Hosterman said she strongly agrees with a 12 month goal, with the ability to request <br /> additional time if necessary. <br /> Councilmember McGovern cautioned that setting a finite period of time combined with the "good <br /> cause" clause creates an opportunity for litigation. <br /> Mayor Hosterman requested that the staff recommendation state a goal of 12 months, will the <br /> collective opportunity to determine that additional time is required. <br /> Councilmember Thorne said he could support that recommendation if the 12 month period <br /> begins after a reasonable education process of, perhaps, three months. <br /> Vice -Mayor Cook Kallio said she does not believe that a goal of 12 months indicates a finite <br /> amount of time, but rather that it means the task force should do its very best to complete the <br /> scope of work in that time. She said it is perfectly conceivable that an additional 12 months <br /> could be required but that such information is not available until the process is underway. She <br /> said she could support Councilmember's Thorne request for an education period. <br /> Mayor Hosterman asked if staff felt comfortable with a three month timeline for providing an <br /> education process of that magnitude. <br /> Mr. Fialho said he could not commit staff to that. He suggested that the entire context could be <br /> changed by inserting the word "strive" so that it reads, "...strive to reach a consensus on the <br /> future of Hacienda and complete the planning process within 12 months, with a report to be <br /> submitted to the Council at the conclusion of 12 months to determine whether progress is being <br /> made or an extension should be provided." <br /> Mr. Fialho reminded the Council that, as stated in Mr. Dolan's presentation, staff believes 12 <br /> months to be an overly optimistic goal. He believes it is more likely a 12 to 15 month process <br /> but that the objective should be 12 months. <br /> It was m/s by Hosterman /Cook Kallio to approve the staff recommendation, with the <br /> amendments that the scope of work be limited to the area around the BART station; that the <br /> task force provide the Council with a status report at the end of 12 months and to include the <br /> proposed language provided by Mr. Fialho. <br /> Councilmember Sullivan inquired about the other suggestions made by Councilmember <br /> McGovern surrounding green building and sustainability. <br /> Mayor Hosterman said those issues would be considered by the Council at the time that the <br /> actual development projects come forward. <br /> City Council Minutes Page 14 of 21 November 3, 2009 <br />
