successful and poorly implemented TODs so that everyone involved can really grasp what such
a development means. She reiterated her desire to see the concepts of green building and
sustainability supported.
Mayor Hosterman said those matters will be addressed when the Council is working through the
specific development projects.
Councilmember Sullivan suggested that, rather than a deadline, the task force provide the
Council with a report at the end of 12 months which outlines what has been determined, what is
still needed, and how much time that would require.
Councilmember McGovern offered support for that. She noted that financial encumbrances
could affect new residents as well and asked the City Manager if this process will include a
study of possible solutions to that burden.
Mr. Fialho explained that it is outlined in the scope of work as an item that staff needs to
research, explore, and ultimately provide a recommendation on. He said he has been asked by
residents to convene an initial meeting with James Paxson and some of the stakeholders to
discuss residents' concerns and possible options to resolve these in advance of this process.
He could not be sure that the discussion would end in something that aligns with what residents
may ask for but said that, at the least, an initial discussion could lead to something else and
ease some of the friction associated with this process. He stressed that there is no commitment
on the part of staff that the residents' desired outcome can be achieved outside of the task force
process.
Councilmember McGovern said that applying any of these extra costs to TOD residents would
most likely raise the cost of these units well outside the range of affordability.
Mayor Hosterman appreciated the thoughts and comments of the Council and said she largely
agreed with everything.
MOTION: Mayor Hosterman made a motion to adopt staff's recommendation with the
adjustments that the scope of work be limited to the area around the BART station and that the
task force provide the Council with a status report at the end of 12 months.
Councilmember Sullivan requested the removal of any language which anticipates the process
will be complete in 12 months.
Vice -Mayor Cook Kallio pointed out that the timeframe is not binding, provided the Council
determines it is appropriate for the task force to continue. She said she would like some
constraints in order to press people towards a solution. To Councilmember McGovern's point
regarding holiday and travel seasons, she said it is important that those who are appointed to
the task force be fully committed to the process.
Councilmember Sullivan said he would the like the language to reflect some flexibility in the
anticipated timeframe; that the timeframe could be 12 to 18 months and at the end of 12
months, the task force will provide the Council with a status report, and recommendations
developed to date, and any requests for additional time.
Vice -Mayor Cook Kallio directed him to page 4 of the staff report which states a goal, "to reach
a consensus on the future of Hacienda and complete the Planning process within 12 months."
City Council Minutes Page 13 of 21 November 3, 2009
