Option C: Select a subcommittee of one or two Council members to write the <br /> argument. And, additional Council members agree to sign the argument <br /> as written by the subcommittee, but those additional Council members will <br /> not discuss, make comments on, changes to, or in any way try to influence <br /> the text of the argument drafted by the subcommittee. Such non editorial <br /> signing can take place without the requirement for a public meeting, and <br /> the argument can then be submitted to the City Clerk. <br /> If the Council wishes to make a rebuttal argument, staff recommends that the Council <br /> select a subcommittee comprised of one or two Council members to draft such rebuttal <br /> argument. The Council members on the rebuttal subcommittee can be different than the <br /> Council members on the direct argument subcommittee. For the rebuttal, the Council <br /> would have options, as detailed above, regarding the drafting of the rebuttal argument, <br /> and the Council members and third parties co- signing the rebuttal. If three or more <br /> Council members desire to discuss the language of the rebuttal argument (Option B, <br /> above), the Council must discuss the wording of the rebuttal argument at a public <br /> meeting. <br /> Council's decision regarding the writing and signing of the direct and rebuttal arguments <br /> will be included in the attached resolution. <br /> Recommended Actions. <br /> 1. Staff recommends that the Council accept the City Clerk's certification based on the <br /> attached information received from the Register of Voters. <br /> 2. Hear a presentation regarding Election Code requirements for referendum petitions. <br /> 3. Continue until February 2, 2010, Council discussion and action regarding the decision <br /> on the referendum petition, and, if the matter is submitted to the voters, related <br /> election procedures, including: <br /> A. Council must subsequently decide whether to: <br /> a. Repeal Ordinance No. 1961; or <br /> b. Submit Ordinance No. 1961 to the voters. <br /> If the Council decides to submit the matter to the voters, Council must select <br /> either the June 8th or November 2nd election date, or decide on a different <br /> special election date and <br /> 1. Adopt the attached resolution calling for Ordinance No. 1961 to be <br /> submitted to the voters at the election selected by the Council; <br /> 5 As noted above, if all five Council members do not sign the argument, the subcommittee should be delegated the <br /> authority to select third parties to co -sign the argument, for a total of five signers. <br /> Page 5of6 <br />
