condition allows the City to bring the application back to the Planning Commission to <br /> add mitigating conditions of approval. Such conditions could include reducing the <br /> days /hours of music, prohibiting the use of amplified music or instruments, etc. The <br /> conditional use permit could also be revoked, if necessary. <br /> Should the Council decide to require noise monitoring, staff has drafted a condition in <br /> the "Options for Consideration" section below. The condition would require the <br /> applicant to measure the outdoor noise levels with a calibrated sound meter at least <br /> three times nightly each evening indoor music occurs and to take immediate action <br /> should the noise level exceed City noise regulations. <br /> Security <br /> The applicant has stated that she currently employs security staff on Friday and <br /> Saturday nights to check identification and to maintain order inside and outside of the <br /> business. At the Planning Commission hearing, the applicant stated that it was her <br /> intention to also utilize security on Wednesday and Thursday nights during the indoor <br /> music hours. <br /> As presently drafted, the conditions of approval do not address this item. Should the <br /> Council decide to include a condition of approval to memorialize the applicant's intention <br /> to maintain security, staff has drafted a condition in the "Options for Consideration" <br /> section below. This condition would require the applicant to provide security staff during <br /> the indoor music hours subject to the satisfaction of the Chief of Police. <br /> Meetings with Neighbor <br /> On December 17, 2009, Planning Division and Police Department staff met with Gene <br /> and Genie Finch, who own and live in the second floor apartment unit approximately 30 <br /> feet east of the subject property at 312 St. Mary Street. The Finches indicated that they <br /> don't necessarily oppose the applicant's proposal and requested that the applicant be a <br /> good neighbor and comply with the conditions of approval. The Finches also indicated <br /> that they would strongly oppose a request for outdoor music. Staff assured the Finches <br /> that the City would enforce the conditions of approval and encouraged them to call the <br /> City if problems were to arise. <br /> The Community Development Director also met with the Finches in their home on <br /> January 8, 2010. The Finches expressed their ongoing concern about litter, loitering, <br /> smoking, and other activity in front of their front door. They also reiterated their concern <br /> about outdoor music that occurred during the summer as authorized by the temporary <br /> use permit issued to the Pleasanton Downtown Association. <br /> Mr. Finch came to the Community Development Department counter on January 10, <br /> 2010, and spoke with staff about the same concerns as above. He also expressed his <br /> opinion that the Redcoats staff has promised a lot, but has delivered very little in terms <br /> of controlling its patrons. He also indicated that he felt the Redcoats activities needed <br /> to be subject to ongoing noise monitoring. <br /> Page 4 of 7 <br />
