the average working day during the peak month of Sewage <br />generation. <br />b. The Applicant may request the <br />Director to make an adjustment to the Sewage Capacity <br />estimated at the time the permit is issued, and receive <br />a partial refund from the connection fee paid, if the <br />Applicant is able to show that the actual discharge <br />after one (1) year of operation is at least ten percent <br />(10 less than the Flow estimated for connection <br />purposes. <br />§2- 15.30.03. ALLOCATION OF CAPACITY TO EXISTING <br />USERS. For purposes of this Chapter, the Capacity allocated <br />to any existing Commercial User or Industrial User shall be <br />the larger of (I) the Capacity purchased upon obtaining a <br />City connection permit, or (ii) the average day maximum <br />month discharge, including both Flow and strength character- <br />istics, during the calendar year 1982, or some prior year <br />when it can be shown to the satisfaction of the Director <br />that some prior year's Flow is more representative of a <br />User's Flow than that occurring in 1982. Sewage connections <br />issued on a fixture unit basis prior to the year 1979 shall <br />be considered to have Capacity equivalent to two hundred <br />eighty (280) gallons per day for every twenty -one (21) <br />fixture units; those issued on or after January 1, 1979 <br />shall be considered to have Capacity equivalent to two <br />hundred twenty (220) gallons per day for every twenty -one <br />(21) fixture units. <br />§2- 15.30.04. LAPSE OF CONNECTION PERMIT. A con- <br />nection permit shall lapse and be o£ no further effect upon <br />the lapse of the building, plumbing, or other permit requir- <br />ing the issuance of the connection permit. The connection <br />fees paid to the City shall be refundable upon the appli- <br />cant's request in event the connection permit has lapsed. <br />§2- 15.30.05. RESTRICTIONS ON USE OF SEWERAGE <br />SERVICE; INSPECTION OF PREMISES. The use of the Side Sewer <br />connection shall be limited to the facilities covered by the <br />connection permit. Before connecting any additional facili- <br />ties to the Side Sewer, the property owner shall make appli- <br />cation to the City for such service and pay such additional <br />fees as may be applicable. In the event the Applicant <br />desires to make greater than one (1) connection to the Side <br />Sewer with respect to a single property, the Applicant shall <br />apply for the same and the permit may allocate such connec- <br />tion rights to specific portions of the property. Periodic <br />inspection of the Premises may be made by the Director to <br />determine if any unauthorized connections have been made. <br />15. CityD�uLL <br />
