THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> IDL£ ASA N TON. <br /> December 14, 2009 <br /> Mayor and City Council <br /> TITLE: APPROVE EMPLOYMENT CONTRACT WITH JONATHAN LOWELL AS <br /> CITY ATTORNEY TO BE EFFECTIVE JANUARY 4, 2010 <br /> SUMMARY <br /> Mr. Jonathan Lowell has been selected by the Mayor and City Council for the position of <br /> City Attorney. Mr. Lowell comes from the City of San Luis Obispo, where he has served <br /> as City Attorney since 2003. Prior to that he was in private practice with the San <br /> Francisco law firm of Curiale, Dellaverson, Hirschfield, Kraemer Sloan. Mr. Lowell <br /> was also the City Attorney for the City of San Bruno, and an Assistant City Attorney for <br /> the cities of Livermore and Hayward. He received his J.D. from Hastings College of Law <br /> and holds a B.S. from the University of California, Berkeley. <br /> Mr. Lowell exceeds the rigorous criteria for the position of City Attorney. He is well <br /> versed in land use issues, negotiations, CEQA actions, and the full range of legal and <br /> administrative proceedings. He also brings the additional benefit of a statewide <br /> overview of the legal challenges facing California cities in his role as the incoming 2011 <br /> President of the League of California Cities, City Attorneys Department. <br /> In his role as Pleasanton City Attorney, Mr. Lowell will provide advice and counsel to the <br /> City Council, the City Manager and staff. He will oversee a legal department that <br /> handles the city's contractual, regulatory, and litigation matters that typically include <br /> open meeting and public records laws; conflicts of interest; land use and environmental <br /> laws; claims and litigation; municipal elections; employment and labor relations; code <br /> enforcement, and other legal matters. <br /> Mr. Lowell will assume the responsibilities of City Attorney effective January 4, 2010. <br /> RECOMMENDATION <br /> Approve the attached employment contract which confirms the appointment of Jonathan <br /> Lowell as City Attorney effective January 4, 2010, with an annual salary of $195,000. <br /> FINANCIAL STATEMENT <br /> Funds in the 2009 -2010 Operating Budget have been allocated for this purpose. <br /> Submi on b ha Z-- f the City Council: <br /> ag <br /> Jennifer Hosterman <br /> Mayor <br />
