CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 02-138 RESOLUTION ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 02-01, FIRST STREET-KOTTINGER DRIVE WHEREAS, by Resolution No. 02-123, a public hearing was set for December 17, 2002 at the hour of 7:00 p.m. in the City Council Chambers, Pleasanton, California, to ascertain whether the public necessity, health and safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric communication, or similar associated services, within that certain area of the City described as U.U.D. No. 02-01 (FIRST STREET-KOTTINGER DRIVE) and as shown on the attached Exhibit "A"; and WHEREAS, notice for such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an oppommity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council hereby finds and determines that the public necessity, health, safety, and welfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for the supplying of electric, communication, or similar or associated services along First Street and Kottinger Drive, such described area is shown on the attached Exhibit "A", which is hereby incorporated as part of this resolution, delineating the boundaries of said District. Section 2: The City Council hereby makes the following further fmdings with regard to Underground Utility District No. 02-01:
