The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />As previously stated, the dirt stockpiles are interim. The stockpiled dirt will be <br />used to grade this site in conjunction with its future development with a senior <br />care facility. The stockpiled dirt on this property would make efficient use of the <br />resources available to the applicant the surplus dirt from the nearly residential <br />development would not have to be off hauled to a landfill or to another <br />development site across City streets and, potentially, through residential <br />neighborhoods, nor would dirt have to be imported to this site when it develops. <br />Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The applicant would contribute $5,000 to the City's Urban Forestry Fund for <br />removing a marginally healthy tree from the area of the stockpiles. As proposed <br />and conditioned, the dirt stockpiles implement the applicable urban stormwater <br />runoff and erosion control measures, e.g. hydroseeding, perimeter hay bales, etc. <br />so as to be compatible with the subject property and with surrounding properties. <br />As conditioned, if problems were to arise with the stockpiles, the City can review <br />the conditional use permit at a public hearing and require additional conditions to <br />correct the problem. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Approves Case PCUP -131, the application of Bill Kolb for conditional use permit <br />approval to permit the interim stockpiling of soil on the rear portion of a site <br />located at 11393 Dublin Canyon Road, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
