PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. PC- 2004 -70
RESOLUTION APPROVING THE APPLICATION OF BILL KOLB FOR CONDITIONAL
USE PERMIT, AS FILED UNDER CASE PCUP -131
WHEREAS, Bill Kolb has applied for conditional use permit approval to permit the interim
stockpiling of soil on the rear portion of a site located at 11393 Dublin Canyon
Road; and
WHEREAS, zoning for the property is PUD LDR/C /PHS/WO (Planned Unit Development
Low Density Residential/ Commercial /Public Health and Safety/Wildlands
Overlay) District; and
WHEREAS, at its duly noticed public hearing of December 8, 2004, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and
WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); therefore, no environmental
document accompanies this report; and
WHEREAS, the Planning Commission made the following findings:
1. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.
The Kolb property is zoned for a future senior care facility. Pending
review /approval of a site specific PUD development plan for this facility, the
stockpiled dirt would be used to raise the level of the rear portion of the Kolb
property to match the grade level of Dublin Canyon Road. The location of the
stockpiled dirt on the Kolb property is well separated from Dublin Canyon Road
so as not to be visible to the public right -of -way and from Devaney Canyon
Creek. The measures proposed by the applicant with this project, the conditions
of approval, and the regulations of the Pleasanton Municipal Code give to the City
the appropriate controls to ensure that these interim dirt stockpiles would not have
a negative impact on the site or on nearby properties. Therefore, this finding can
be made.
