PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC- 2004 -70 <br />RESOLUTION APPROVING THE APPLICATION OF BILL KOLB FOR CONDITIONAL <br />USE PERMIT, AS FILED UNDER CASE PCUP -131 <br />WHEREAS, Bill Kolb has applied for conditional use permit approval to permit the interim <br />stockpiling of soil on the rear portion of a site located at 11393 Dublin Canyon <br />Road; and <br />WHEREAS, zoning for the property is PUD LDR/C /PHS/WO (Planned Unit Development <br />Low Density Residential/ Commercial /Public Health and Safety/Wildlands <br />Overlay) District; and <br />WHEREAS, at its duly noticed public hearing of December 8, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document accompanies this report; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The Kolb property is zoned for a future senior care facility. Pending <br />review /approval of a site specific PUD development plan for this facility, the <br />stockpiled dirt would be used to raise the level of the rear portion of the Kolb <br />property to match the grade level of Dublin Canyon Road. The location of the <br />stockpiled dirt on the Kolb property is well separated from Dublin Canyon Road <br />so as not to be visible to the public right -of -way and from Devaney Canyon <br />Creek. The measures proposed by the applicant with this project, the conditions <br />of approval, and the regulations of the Pleasanton Municipal Code give to the City <br />the appropriate controls to ensure that these interim dirt stockpiles would not have <br />a negative impact on the site or on nearby properties. Therefore, this finding can <br />be made. <br />
