to be processed as a minor modification with notice sent <br /> to the Pleasanton Hills Owner's Association and <br /> neighboring residents. <br /> <br />5. In the event the private park is annexed to the <br /> Association, it shall be installed at developer's <br /> expense concurrently with the development of the <br /> project; development shall include irrigation, turf, <br /> shrubs, play area, and minimum 15-gallon trees. The <br /> final design of the park shall be subject to approval by <br /> the Pleasanton Hills Owners' Association and the' <br /> Planning Director. <br /> <br />6. That a fencing plan for the perimeter of the project and <br /> on property lines between residences shall be submitted <br /> for Planning Director approval prior to the approval of <br /> a final map; where said plan includes wooden or wrought <br /> iron fences, they shall be of similar design and <br /> materials to those existing in the Pleasanton Hills <br /> subdivision. Said fencing plan shall also provide for <br /> the following: <br /> <br /> a. at the option of the owner of Lot 37 of Tract 4611, <br /> and eight foot fence may be installed along the <br /> northerly border of Lot 12; <br /> b. at the option of the owners of Lots 46 and 47 of <br /> Tract 4611, respectively, no fence may be installed <br /> along their respective easterly property lines; <br /> c. fencing along the pathway shall meet City <br /> requirements for fences abutting public property, <br /> the final design to be approved by the Planning <br /> Director prior to approval of the final map; and <br /> d. the existing fence along the southerly boundary may <br /> be retained. <br /> <br />7. That the developer shall grant view easements, satisfac- <br /> tory to the City Attorney, to the owners of Lots 46 and <br /> 47 of Tract 4611, to run with the land, establishing a <br /> view easement over Lots 3 through 8 which will set a <br /> maximum roof peak height for residences constructed on <br /> those lots equal to an elevation of five (5) feet above <br /> the finished floor elevations of Lots 46 and 47. <br /> <br /> - 2 - <br /> <br /> <br />
