to be processed as a minor modification with notice sent to the Pleasanton Hills Owner's Association and neighboring residents. 5. In the event the private park is annexed to the Association, it shall be installed at developer's expense concurrently with the development of the project; development shall include irrigation, turf, shrubs, play area, and minimum 15-gallon trees. The final design of the park shall be subject to approval by the Pleasanton Hills Owners' Association and the' Planning Director. 6. That a fencing plan for the perimeter of the project and on property lines between residences shall be submitted for Planning Director approval prior to the approval of a final map; where said plan includes wooden or wrought iron fences, they shall be of similar design and materials to those existing in the Pleasanton Hills subdivision. Said fencing plan shall also provide for the following: a. at the option of the owner of Lot 37 of Tract 4611, and eight foot fence may be installed along the northerly border of Lot 12; b. at the option of the owners of Lots 46 and 47 of Tract 4611, respectively, no fence may be installed along their respective easterly property lines; c. fencing along the pathway shall meet City requirements for fences abutting public property, the final design to be approved by the Planning Director prior to approval of the final map; and d. the existing fence along the southerly boundary may be retained. 7. That the developer shall grant view easements, satisfac- tory to the City Attorney, to the owners of Lots 46 and 47 of Tract 4611, to run with the land, establishing a view easement over Lots 3 through 8 which will set a maximum roof peak height for residences constructed on those lots equal to an elevation of five (5) feet above the finished floor elevations of Lots 46 and 47. - 2 -
