Section 17.28,020 Findings of Overcrowding - School District <br /> Action <br /> <br /> The governing body of any school district which provides <br />elementary, junior high or high school service to an area within <br />the City limits of the City of Pleasanton may make findings, <br />which shall be supported by substantial evidence: <br /> <br /> (a) That conditions of overcrowding exist or will exist <br /> given projected residential development within that <br /> district in the next five years in one or more <br /> attendance areas within the district. "Conditions <br /> of overcrowding" means that the total enrollment of <br /> a school exceeds the designed capacity of such <br /> school as reasonably determined by the governing <br /> body of the district. <br /> <br /> (b) That the overcrowding will impair the normal <br /> functioning of educational programs. <br /> <br /> (c) The reasons for such conditions existing; and <br /> <br /> (d) That all reasonable methods of mitigating <br /> conditions of overcrowding have been evaluated <br /> (including application for state assistance <br /> pursuant to the Leroy F. Greene State School <br /> Building Lease - Purchase Law of 1976) and no <br /> feasible method of reducing such conditions exist. <br /> <br /> In this chapter, these four findings taken together may <br />be referred to as "findings of overcrowding." <br /> <br /> Section 17.28,030 Findings of Overcrowding - City Council Action <br /> After a school district has made findings of <br /> overcrowding pursuant to Section 17.28,020, and transmitted its <br /> findings and supporting evidence to the City Council , the City <br /> Council shall determine by resolution whether the findings of the <br /> school district are supported by substantial evidence. <br /> <br /> In this chapter, findings of overcrowding which the City <br /> Council determines to be supported by substantial evidence may be <br /> referred ~o as "approved findings of overcrowding." <br /> <br /> Section 17.28.040 Development to Which This Ordinance Applies <br /> <br /> (a) This chapter shall apply to each new residential <br /> dwelling unit in each district for which there are approved <br /> findings of overcrowding except as provided in subsection (b). <br /> <br /> (b) Those specific dwelling units which have been <br /> designated for senior citizen low and moderate income households <br /> pursuant to the City's Growth Management Program shall be exempt <br /> from fees or alternate methods of compliance required by this <br /> chapter. <br /> <br /> - 4 - <br /> <br /> <br />
