CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1257 <br /> <br /> AN ORDINANCE ESTABLISHING A SCHOOL IMPACT FEE FOR RESIDENTIAL <br /> CONSTRUCTION <br /> <br /> PREAMBLE <br /> <br /> A. The State of California has developed no long term <br />comprehensive solution to the acute and chronic facilities <br />financing needs of local school districts. The California <br />Supreme Court determined in the case of Candid Enterprises, Inc. <br />v. Grossmont Union High School District 218 Cal.Rptr. 303 (1985) <br />that the State has enacted merely "a series of stop-gap, <br />patchwork measures." <br /> <br /> B. Overcrowding of some schools in Pleasanton has <br />reached crisis proportions as documented in a report from Bill <br />James, Superintendent of Schools to the Board of Trustees and <br />City Council. <br /> <br /> C. A significant factor in causing the overcrowding of <br />schools is residential housing expansion. For example, the <br />population of the City of Pleasanton has grown from 36,854 in <br />January 1983 to 45,371 in January 1986. During that same period, <br />the population of elementary school aged children in Pleasanton <br />(K through 8) has grown from 3,883 to 4,201. It is anticipated <br />that continuing residential growth will exacerbate crowded school <br />conditions unless mitigated. <br /> <br /> D. The Land Use Element of the City of Pleasanton <br />General Plan affirms that high quality schools are essential to <br />the quality of life of this community. The Land Use Element <br />further commits the City to undertake measures to cooperate with <br />the school districts to preserve and enhance the quality of our <br />educational system consistent with the City's limited <br />governmental role and applicable legal constraints. This <br />ordinance is adopted in furtherance of established goals in the <br />Land Use Element. <br /> <br /> E. The sole purpose of this ordinance is to provide a <br />method whereby new residential development can fairly pay for a <br />portion of the additional educational capital facilities required <br />to serve that new development. The benefits of this ordinance <br />accrue to the new residential development by assuring the <br />residents of new housing that the quality of local education will <br />not deteriorate because of their addition to the community. This <br />ordinance is not adopted to prevent or discourage new housing <br />construction. This ordinance is adopted as a reasonable <br />accommodation between the needs for new housing and the need to <br />preserve the quality of life of the community through planning. <br /> <br /> - 1 - <br /> <br /> <br />
