NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. Third Supplemental Agreement. All terms and conditions of the Third Supplemental Agreement remain in effect except as modified by this Fourth Supplemental Agreement. 2. Modifications to Third Supplemental Agreement. (a) Section 6(b)(1i). In Section 6(b)(ii) of the Third Supplemental Agreement delete "..ending December 31, 2009,..." and replace with "...ending December 31, 2011,... 4. Integration. This Fourth Supplemental Agreement constitutes the entire agreement between the parties regarding the subject matter hereof; provided, that nothing herein contained shall be deemed a limitation upon the parties to enter into further supplemental agreements. 5. Successors. This Agreement, and the duties, obligations, and rights of the parties shall be binding upon, and inure to the benefit of, their successors. 6. Severability. The provisions of this Agreement are severable, such that if any paragraph, sentence, clause, phrase, or other provision of this Agreement, or the application thereof to either party, or to any other person or circumstance is, for any reason, held invalid by a court of competent jurisdiction, said invalid portion shall be deemed severable and the remainder of the agreement or the application thereof to the other party or to other persons shall not be affected thereby. 7. Effect on Basic Agreement. Except to the extent supplemented or modified hereby, all terms, conditions and provisions of the Basic Agreement, as previously supplemented, shall remain, and are, in full force and effect. 8. Paragraph Headings. Paragraph and subparagraph headings contained herein are for convenience only and shall not be deemed to amend, or affect the interpretation of, the paragraph or subparagraphs headed thereby.
