FOURTH SUPPLEMENTAL AGREEMENT <br /> TO <br /> AGREEMENT FOR WASTEWATER DISPOSAL SERVICES <br /> This Agreement made and entered into this day of 2009, <br /> by and between the CITY OF PLEASANTON, a municipal corporation (City) and the <br /> DUBLIN SAN RAMON SERVICES DISTRICT, a public agency of the State of California <br /> (District); <br /> WITNESSETH: <br /> WHEREAS, City and District entered into that certain Agreement entitled Agreement <br /> for Wastewater Disposal Services dated November 3, 1992, (hereinafter defined as the Basic <br /> Agreement), by which the requirements for City's and District's wastewater treatment and <br /> disposal are provided; and <br /> WHEREAS, supplemental agreements may be made to the Basic Agreement pursuant <br /> to Paragraph 17 thereof; and <br /> WHEREAS, City and District entered into Third Supplemental Agreement to Agreement <br /> for Wastewater Disposal Services dated November 19, 2002; and <br /> WHEREAS, the Third Supplemental Agreement clearly establishes the City's first right <br /> to use City's secondary effluent for recycling, and <br /> WHEREAS, the Third Supplement Agreement provides District may use up to two and <br /> one half (2.5) million gallons per day of City's Secondary Effluent to produce recycled water, <br /> and <br /> WHERWAS, District's use of City's Secondary Effluent expires on December 31, <br /> 2009,: and <br /> WHEREAS, Third Supplemental Agreement provides City will negotiate in good faith <br /> for an extension of the District's use of City's Secondary Effluent; and <br /> WHEREAS, City and District desire to make a portion of Secondary Effluent in excess <br /> of the City current needs available for use by District for landscape and agricultural irrigation <br /> recycling; and <br /> WHEREAS, City and District are meeting on a regular basis to develop revisions to the <br /> Basic Agreement including provisions regarding recycled water; and <br /> WHEREAS, City desires to continue to support use of recycled water within the Zone 7 <br /> potable water service area to reduce dependence on imported water. <br /> Page 1 of 3 <br />
