pavers, maintenance of pavers, or the street sweeping performed by the HOA, <br /> its contractor, or designee. <br /> 4. Insurance: Ponderosa Homes (and its successor HOA) shall be responsible for <br /> insuring that all contractors that perform work on the public portion of <br /> Bradford Way shall maintain in full force and effect at their own cost and <br /> expense the insurance polices described below and that those policies name as <br /> additional insured the City of Pleasanton, its officers, employees and agents. <br /> The policies shall state in writing either on the Certificate of Insurance or <br /> attached rider thereof that this insurance will operate as primary insurance <br /> under this Agreement, and that no other insurance effected by City or other <br /> named insured will be called on to cover a loss covered hereunder. <br /> a. General Liability Insurance for at least $1,000,000 combined limit for <br /> bodily injury and property damage <br /> b. Automobile liability insurance in an amount not less than $1,000,000 per <br /> person/per occurrence. <br /> c. Workers' Compensation Insurance for all employees, all in strict <br /> compliance with State laws, and to protect City from any and all claims. <br /> 5. Remedies for Failure to Maintain: If Ponderosa Homes or the HOA fails or <br /> refuses to perform the necessary work required under this Agreement, the City <br /> shall have the right, but not the obligation, to cause such work to be <br /> performed. The City shall first give (30) days written notice to Ponderosa <br /> Homes or the HOA that maintenance, repairs, and /or replacement of the <br /> roadway or decorative paving are necessary. <br /> If Ponderosa Homes or the HOA fails to perform the necessary work within <br /> the timeframe stated by the City, the City shall have the work performed and <br /> Ponderosa Homes or the HOA shall be liable for those costs. Ponderosa <br /> Homes or the HOA shall reimburse the City for all costs and expenses within <br /> ten (10) days of receipt of demand by the City. The City's remedy provided in <br /> this paragraph shall be in addition to any and all other rights and remedies the <br /> City may have at law or in equity. <br /> Notwithstanding the foregoing, in the event the roadway or decorative paving <br /> requires immediate maintenance, repair, or replacement due to a public safety <br /> or health hazard as reasonably determined by the City Engineer, and such work <br /> either cannot be performed or is not performed by Ponderosa Homes or the <br /> HOA within twenty -four (24) hours after receipt of notice from the City, <br /> (which notice may be given by phone or by facsimile), the City may cause <br /> such work to be performed. Ponderosa Homes or the HOA shall reimburse the <br /> City for all costs and expenses related to the work within ten (10) days of <br /> receipt of demand by the City. <br />
