B. Any such regulations promulgated by the Fire Chief <br />shall not establish fees for administration of this chapter- The <br />City Council may, by resolution, adopt a schedule of fees to be <br />collected from each business required to submit a business plan <br />pursuant to Health and Safety Code Section 25500 et seq- <br /> C. Prior to adoption of any regulation pursuant to <br />this chapter of the pleasanton Municipal Code, the Fire Chief <br />shall follow this procedure: <br /> 1. Notice of the proposed adoption of regulations <br /> shall be given by notation on the Agenda of the City <br /> Council- <br /> 2. The Agenda notation shall state a place where <br /> copies of the proposed regulations may be obtained by <br /> any member of the public free of charge- <br /> 3. The Agenda notation shall include a brief <br /> description of the proposed regulations. <br /> 4. The Agenda notation shall give a time and place <br /> not less than fifteen days later than the City Council <br /> date to which the subject Agenda refers, at which public <br /> comments may be received. <br /> 5. The Fire Chief shall send mailed notice to each <br /> identified hazardous materials user of his intention to <br /> adopt regulations- The mailed notice shall contain the <br /> same information as is included in the City Council <br /> Agenda notation and shall be mailed at least fifteen <br /> days prior to the opportunity for public comment. <br /> 6. After receiving public comments, the Chief may <br /> approve the proposed regulations as written or approve <br /> those regulations with modifications based upon comments <br /> received. <br /> 7. Regulations shall take effect thirty days from <br /> the date the Fire Chief approves those regulations <br /> unless appealed as provided in Subsection 8. <br /> 8. A copy of the approved regulations shall be <br /> forwarded to the members of the City Council. Upon <br /> appeal by any member of the City Council, the effective <br /> date of the approved regulations shall be suspended <br /> until affirmed by resolution of the City Council. <br /> D. The Fire Chief shall continuously maintain copies <br /> of all approved regulations available for sale to the public at a <br /> charge not to exceed their reasonable cost of production- <br /> <br /> <br />
