e CITY COUNCIL OF THE CITY OF pLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1251 AN ORDINANCE ASSUMING LOCAL RESPONSIBILITY FOR iMpLEMENTATION OF AB 2185 REGARDING HAZARDOUS MATERIALS RELEASE RESPONSE PLANS AND INVENTORY WHEREAS, the State Legislature recently enacted AB 2185 (Health and Safety Code Section 25500 et seq.) which requires every county to implement hazardous materials release response plans and permits each city to assume that responsibility within its boundaries; and WHEREAS, the Fire Chief has recommended that the City assume responsibility for implementation of AB 2185 (SR 86:134); THE CITY COUNCIL OF THE CITY OF pLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Chapter 9.18 entitled ,,HAZARDOUS MATERIALS RELEASE RESPONSE pLANS" is hereby added to the pleasanton Municipal Code (PMC) to read as follows: ,,Chapter 9.18 HAZARDOUS MATERIALS RELEASE RESPONSE pLANS 9.18.010 Assumption of jurisdiction In accordance with Health and Safety Code Section 25502, the City of pleasanton assumes jurisdiction for implementation of Chapter 6.95 (entitled ,,Hazardous Materials Release Response Plans and Inventory" of Division 20 of the Health and Safety Code (hereafter Health and Safety Code Section 25500 et seq.) within the boundaries of the City of pleasanton- 9.18.020 Administering Agency The Fire Department Of the City of pleasanton shall be the administering agency responsible for administering and enforcing Health and Safety Code Section 25500 et seq. 9.18.030 Adoption of Regulations A. The Fire Chief is hereby authorized to promulgate regulations consistent with the purposes of Health and Safety Code Section 25500 et seq., which are necessary or convenient for the administration and enforcement of this chapter of the pleasanton Municipal Code.
