CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1246 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF THE PRUDENTIAL <br /> INSURANCE COMPANY OF AMERICA FOR REZONING FROM "I-G <br /> (GENERAL INDUSTRIAL)" TO "PUD (PLANNED UNIT <br /> DEVELOPMENT)-INDUSTRIAL/COMMERCIAL AND OFFICES" DISTRICT <br /> AND APPROVING A DEVELOPMENT PLAN FOR A BUSINESS PARK <br /> COMPLEX ON AN APPROXIMATELY 260 ACRE SITE LOCATED <br /> GENERALLY IN THE AREA BOUNDED BY INTERSTATE 580 ON THE <br /> NORTH, TASSAJARA CREEK ON THE EAST, THE RAILROAD TRACKS <br /> OF THE SOUTHERN PACIFIC TRANSPORTATION COMPANY AND <br /> HACIENDA BUSINESS PARK ON THE SOUTH, AND CHABOT DRIVE ON <br /> THE WEST (PUD-85-8) <br /> <br />WHEREAS, The Prudential Insurance Company of America has applied <br /> for rezoning of an approximately 260 acre site located <br /> generally in the area bounded by Interstate 580 on the <br /> north, Tassajara Creek on the east, the railroad tracks <br /> of the Southern Pacific Transportation Company and <br /> Hacienda Business Park on the south, and Chabot Drive on <br /> the west from "I-G (General Industrial)" to "PUD <br /> (Planned Unit Development)-Industrial/Commercial and <br /> Offices" District; and <br /> <br />WHEREAS, in reviewing this application in accordance with the <br /> provisions of CEQA, an Environmental Impact Report (EIR) <br /> has been prepared, public hearings have been held before <br /> the Planning Commission and City Council relative to the <br /> EIR's adequacy and content, and this Council has <br /> certified that it has reviewed and considered the <br /> information contained in the EIR and has found the EIR <br /> complete and adequate (Resolution NO. 86-84); and <br /> <br />WHEREAS, the EIR indicates significant environmental effects <br /> would result from the project, as summarized in the <br /> attached Exhibit "A", Environmental Impact Findings, and <br /> as more completely discussed in the EIR itself; and <br /> <br />WHEREAS, CEQA and State and local EIR guidelines adopted pursuant <br /> thereto require this City Council to make specific <br /> findings where an EIR identifies one or more significant <br /> effects which may result from approval of the project; <br /> and <br /> <br />WHEREAS, this City Council finds that potentially significant <br /> environmental effects either (1) have been mitigated by <br /> project conditions of approval or modifications made to <br /> the project during the review process, (2) require <br /> mitigation by another public agency having jurisdiction, <br /> or (3) cannot be mitigated except by mitigation measures <br /> or alternatives found to be infeasible given economic, <br /> <br /> <br />
