CONDITIONS OF APPROVAL <br /> (PUD-85-21) <br /> <br />1. That the development shall substantially conform to the plans <br /> and elevations on file with the Planning Department except <br /> <br /> a. That the buildable area on Parcel 9 shall be limited to <br /> that northerly portion of the lot as shown on Exhibit A. <br /> <br /> b. That the area within the P.S.E. on Parcel 5 shall be a <br /> landscape area to be maintained by the homeowners' <br /> association- <br /> <br /> c. That the private driveway be redesigned to provide a <br /> flat elevation, or slightly downward slope toward Neal <br /> Street, for a distance of 40 feet from Neal Street in <br /> order to minimize headlight glare into neighboring <br /> windows. <br /> <br /> d. That a retaining wall shall be constructed south of the <br /> 69 inch diameter oak tree and adjacent to the access <br /> road as shown on Exhibit A, subject to the review of the <br /> City Engineer. <br /> <br /> e. That no development, construction, grading, or other <br /> improvements shall occur outside of the buildable area <br /> on Parcel 9 without prior approval of the Planning <br /> Director, and that the design of any residence/building <br /> on Parcel 9 shall require design approval by the <br /> Planning Director prior to issuance of building permits. <br /> <br /> f. That the minimum side yard setback for Parel 9 (between <br /> Parcels 8 and 9 common boundary) shall be 6' except it <br /> may be reduced to 5' only with the construction of a <br /> retaining wall, the design of which is subject to the <br /> review and approval of the Planning Director. <br /> <br /> 2. That unless modified by this development plan, the <br /> development standards of the R-1-7500 District shall apply to <br /> this site. <br /> <br /> 3. That the building height limitation for Parcel 5 and 8 shall <br /> be 16 feet and shall be 25 feet for all other parcels. <br /> <br /> 4. That the developer apply for and receive approval for the <br /> corresponding subdivision of the property. <br /> <br /> 5. That the applicant is aware that Growth Management approval <br /> must be secured prior to further development of the site. <br /> <br /> EXHIB)T B <br /> <br /> <br />
