the Chrisman’s are trying to do and added that the staff report now indicates that the <br />payment for the Specific Plan will follow the five-year increase for the extension. She <br />noted, however, that she did not believe this was a major project to move forward with <br />and that nothing is currently happening on the property. She stated that the 14 lots <br />have been sitting for over a year due to the economy. She voiced concern with <br />precedent-setting, such as with the Lin property. <br />Frank Berlogar expressed support for the Chrismans’ application. He cited the harsh <br />economic crisis and urged the Commission’s support for an extension on their <br />development agreement. With respect to the Lin’s property, he stated that he believed <br />the Council and the Commission will be able to address the bridge. <br />Commissioner Blank disclosed that he knows Mr. Berlogar personally but has not <br />discussed the matter with him. <br />Jim Happ, applicant, clarified that contrary to what Ms. Roberts indicated in her letter <br />that the Chrismans had not contributed anything to the City, the Chrismans had, in fact, <br />paid a full share of the design cost for the new Vineyard Avenue and the Vineyard Trail, <br />and had dedicated the right-of-way. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Blank moved to recommend approval to the City Council of the <br />extension of the development agreement between the City and the Chrismans, <br />subject to the condition that the Chrismans pay the specific plan preparation fee <br />when the Final Map is submitted for approval. <br />Commissioner Narum seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Narum, Pearce, and Pentin. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioners O’Connor and Olson. <br />Resolution No. PC-2009-25 recommending approval of PDAM-2 was entered and <br />adopted as motioned. <br />a.PCUP-249, Joseph and Maricela Barone <br />Application to modify the approved Conditional Use Permit (UP-88-25) <br />for the operation of Barone’s Restaurant located at 475 St. John Street <br />to allow outdoor music and entertainment.
