Mr. Brian Dolan replied sponded that it would be possible but potentially logistically
problematic for the City Council and , depending on how the City Manager as the
Workshop had already been noticed. Nelson Fialho intended to run that jJoint
hearing.

Chair Blank expressed concern regarding leaving the Item unresolved until the next
Planning Commission hearing, and proposed meeting from 6:00 to 6:45 p.m..

Ms. Donna Decker stated that the staff was looking at September 4, 2008 asfor a
possible Planning Commission Special Meeting date. She advised that 5five of the
6six Planning Commissioners would be available on that date, and that they staff
could find other items to place on that agenda. She noted said that this would be the
sStaff’s recommendation so the Commissioners could hear the Item at the earliest
possible time.

Chair Blank commented that either date could work.

Commission Olson confirmed that he was agreeable to meeting at either time, prior
to the Joint City Council / Planning Commission Workshop hearing on August 27,
2008 or at a Special Meeting on September 4, 2008.

Mr. Brian Dolan advised mentioned that in order to be procedurally correct, the
Commission would need a majority vote if it decided not to hear the Item at the next
regularly scheduled meeting.

Chair Blank questioned inquired if the meeting y could start early on Wednesday,
August 27, 2008, and set up Thursday, August 28, 2008, as a Special Meeting in the
event where that the hearing is not completed on August 27ththey could finish the
th
hearing if they are unable to do so on Augustthe 27.

Assistant City Attorney Julie Ms. Harryman indicated that the only issue with doing
this so is that the newspaper announcement publication of the next hearing date had
already gone out, and people were expecting the meeting to start at 7:00 p.m. She
advised that this issue did notn’t prevent them from changing the date and time of
the meeting because staffthey could still pPost a notice news of the change and
send out notification cards, thereby satisfying two of the three the minimum of 2 out
of the 3 noticing requirements.

Chair Blank asked whether they would be able to satisfy all 3three noticing
requirements would be satisfied if the meeting was on August 28, 2008. Ms.

Donna Decker advised that they would still only be able to achieve two2 of the
noticing requirements for the date and staff would want to re-notice.

PLANNING COMMISSION MINUTES, August 13, 2008 Page 3 of 26
