12. <br /> <br />This PUD development plan approval shall lapse within two years from the effective date <br />of the City Council's approval unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion or an extension has been ap- <br />proved by the City. <br /> <br />13. <br /> <br />The project developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval of this <br />case, and that the project developer agrees and acknowledges that building permit ap- <br />proval may be withheld if sewer capacity is found by the City not to be available. <br /> <br />14. <br /> <br />This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building permits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the project developer is participating in the program. Notwith- <br />standing the project developer's participation in such a program, the City may withhold <br />building permits if the City determines that sufficient water is not available at the time of <br />application of building permits. <br /> <br />15. <br /> <br />The building permit plan check materials will be accepted for submittal only after the <br />City Council's introduction of the ordinance covering this development plan. The plan <br />check materials will be accepted before the effective date of the ordinance only if the pro- <br />ject developer submits a signed hold-harmless statement acknowledging that the City is <br />not responsible for the plan check fees nor for the costs associated with the building per- <br />mit plan preparation in the event that Council approval is rescinded. In no case will the <br />City issue a building permit until the effective date of the ordinance approving the pro- <br />ject. <br /> <br />16. <br /> <br />The width of the pedestrian sidewalk where it crosses the drive-through aisle to the car- <br />wash shall be increased to six-feet, and shall be treated with stamped paving. This detail <br />shall be shown on the building permit plan set and shall be submitted to the Planning Di- <br />rector for review and approval before issuance of a building permit. <br /> <br />Planning Requirements: <br /> <br />17. <br /> <br />The project developer shall use their best efforts to implement the measures identified in <br />the U.S. Green Building Council's (USGBC), "Leadership in Energy and Environmental <br />Design (LEED)" 2.0 rating system in the design, construction, and operation of the pro- <br />posed building, including all future tenant improvements. Before issuance of a building <br />permit, the LEED measures detailed in Exhibit "A" dated "Received, August 8, 2002", <br />shall be explicitly stated on a separate sheet of the building permit plan set and shall be <br />subject to review and approval by the Planning Director before issuance of a building <br />permit. <br /> <br />Page 3 of 14 <br /> <br /> <br />
