Exhibit "B", <br /> PUD-02-4M, Final Conditions of Approval <br />Bernal Retail Complex/Service Station, 1875 Valley Avenue <br /> <br /> per City Council <br />September 3, 2002 <br /> <br />General Conditions: <br /> <br />The project covered by this PUD Development Plan approval shall be constructed, main- <br />tained, and operated in substantial conformance to the development plans, Exhibit "A", <br />dated "Received August 26, 2002" on file with the Planning Department, except as modi- <br />fied by the following conditions. Minor changes to the plans may be allowed subject to <br />the approval of the Planning Director if found to be in substantial conformance to the ap- <br />proved exhibits. <br /> <br />All conditions of Case PUD-02 shall remain in full force and effect, except that PUD-02 <br />is modified to allow the following: <br /> <br />Add an additional 1,300 square feet of building floor area for this site for the car- <br />wash structure covered by this approval. This modification is not transferable, <br />however, and applies only to this approved development plan consisting of a self- <br />service gasoline station, convenience market, quick-service restaurant with drive- <br />through lane, and drive-through carwash. Additionally, the carwash structure may <br />not be converted to any other type of use other than a self serve carwash unless <br />PUD-02 is further modified, said modification requiring review by the Planning <br />Commission and by the City Council. <br /> <br />bo <br /> <br />The sale of beer and wine only as a conditional use from the convenience market <br />operated with a service station. <br /> <br />The building heights and separations shown on the approved development plans, includ- <br />ing setbacks from property lines and separations between buildings, shall constitute the <br />development standards for this site. <br /> <br />Any changes to the buildings' designs, heights, and separations covered by this approval <br />including, but not limited to, materials, colors, detailing, setbacks, etc., shall be reviewed <br />as an application for design review approval following the procedures listed under Chap- <br />ter 18.20, Design Review, of the Pleasanton Municipal Code. Any changes to the opera- <br />tions of the uses covered by this approval including, but not limited to, hours of operation <br />of the service station, drive-through, etc., shall be reviewed as a modification of the con- <br />ditional use permit approval following the procedures listed under Chapter 18.124, Con- <br />ditional Uses, of the Pleasanton Municipal Code.
