- 58 - <br /> <br /> 8.11 Commercial Use Channels. Grantee shall make <br /> <br /> channels available for commercial use, on a nondiscriminatory <br /> basis, as required by federal law. All commercial channel service <br /> revenues shall be included in gross receipts subject to the <br /> franchise fee. <br /> <br /> 8.12 Alternative Use of Access Channels. If Grantor <br /> <br /> determines that a new service affecting the public safety, health <br /> or welfare, would be in the public interest and receives a bona <br /> fide offer from a third party to provide such a service, Grantee <br /> shall be offered the first right of refusal to provide the <br /> service on the same terms. If Grantee declines tq provide the <br /> service, Grantor may utilize appropriate access channel capacity <br /> to accommodate that service. <br /> <br /> 8.13 Universal Connection. The Grantor may require <br /> <br />that all dwelling units within the franchise area shall be <br />connected physically to the cable system by the Grantee by means <br />of drop cables terminating at each dwelling unit, whether or not <br />the dwelling unit's occupants desire to subscribe to cable <br />service. The cost and charges for providing universal connection <br />shall be determined by the Grantee at the time such connection is <br />requested and furnished to the Grantor. If Grantor elects to <br />require universal connection, Grantee shall be entitled to recover <br />the incremental cost o'.f providing a universal connection. <br /> <br /> <br />
