Section 10. Residential Construction Tax Refund. PMC Section 1-6.63 is amended to read as follows with deleted language in crossed out and added language underscored: Section 1-6.63: Time of Payment and Refunds. The residential construction tax herein required to be paid shall be due and payable upon issuance by the City of Pleasanton of a building permit for the construction of any residential dwelling unit or upon issuance by the City of Pleasanton of a permit to connect sewer and water lines to service a mobile home lot in a mobile home park, and no such permit shall be issued until said tax is paid; provided, however, that there shall be a refund of such tax to the person who paid such in the event that the building permit or permit to connect to sewer and water lines to service a mobile home lot in a mobile home park expires within the meaning of ~~ ~d~/~ the Uniform Building Code ~/~~/~dN~ ~/as currently adopted and administered by the City, if within thirty (30) days after the date of such expiration written application for such refund is filed by the person who paid such tax setting forth in full the facts showing that such permit has expired. Section 11. Business License Violations. PMC Section 1-5.44 is amended in its entirety to read as follows: Section 1-5.44: Penalty for Violation. Any person convicted of violating any of the provisions of this Article, including but not limited to knowingly or intentionally misrepresenting to any officer or employee of this City any material fact in procuring the license or permit herein provided for, shall be guilty of a misdemeanor and subject to the general penalty provided for by Section 1-1.11 of this Code. Section 12. Fortune Telling Article Deleted. PMC Sections 4-4.17 through 4-4.19 relating to the practice of "fortune-telling" are deleted from the Pleasanton Municipal Code. Section 13. Regulation of Solicitors and Certain Businesses. PMC S~c~ion 4-1.24 is hereby d~le~ed with r~fer~nc~ to previous section 4-1.24 eliminated in Section 4-1.25. Section 14. Massage Establishments: Refusal to Consent to Search as Basis for Permit Revocation. PMC Section 4-2.1417 is amended by minor language changes and by deleting the last clause in the first sentence so that the Section reads as follows: Section 4-2.1417: Revocation or Suspension of Permit. Any permit issued for a massage establishment may be revoked or suspended by the Chief of Police, after a hearing conducted pursuant to Section 4-2.1419, in any case where any employee of the permittee, including but
