Section 10. Residential Construction Tax Refund. PMC Section <br /> 1-6.63 is amended to read as follows with deleted <br /> language in crossed out and added language underscored: <br /> <br /> Section 1-6.63: Time of Payment and Refunds. The <br /> residential construction tax herein required to be paid <br /> shall be due and payable upon issuance by the City of <br /> Pleasanton of a building permit for the construction of <br /> any residential dwelling unit or upon issuance by the <br /> City of Pleasanton of a permit to connect sewer and <br /> water lines to service a mobile home lot in a mobile <br /> home park, and no such permit shall be issued until said <br /> tax is paid; provided, however, that there shall be a <br /> refund of such tax to the person who paid such in the <br /> event that the building permit or permit to connect to <br /> sewer and water lines to service a mobile home lot in a <br /> mobile home park expires within the meaning of ~~ <br /> ~d~/~ the Uniform Building Code ~/~~/~dN~ <br /> ~/as currently adopted and administered by the City, if <br /> within thirty (30) days after the date of such <br /> expiration written application for such refund is filed <br /> by the person who paid such tax setting forth in full <br /> the facts showing that such permit has expired. <br /> <br />Section 11. Business License Violations. PMC Section 1-5.44 is <br /> amended in its entirety to read as follows: <br /> <br /> Section 1-5.44: Penalty for Violation. Any person <br /> convicted of violating any of the provisions of this <br /> Article, including but not limited to knowingly or <br /> intentionally misrepresenting to any officer or employee <br /> of this City any material fact in procuring the license <br /> or permit herein provided for, shall be guilty of a <br /> misdemeanor and subject to the general penalty provided <br /> for by Section 1-1.11 of this Code. <br /> <br />Section 12. Fortune Telling Article Deleted. PMC Sections <br /> 4-4.17 through 4-4.19 relating to the practice of <br /> "fortune-telling" are deleted from the Pleasanton <br /> Municipal Code. <br /> <br />Section 13. Regulation of Solicitors and Certain Businesses. <br /> PMC S~c~ion 4-1.24 is hereby d~le~ed with r~fer~nc~ to <br /> previous section 4-1.24 eliminated in Section 4-1.25. <br /> <br />Section 14. Massage Establishments: Refusal to Consent to Search <br /> as Basis for Permit Revocation. PMC Section 4-2.1417 is <br /> amended by minor language changes and by deleting the <br /> last clause in the first sentence so that the Section <br /> reads as follows: <br /> <br /> Section 4-2.1417: Revocation or Suspension of Permit. <br /> Any permit issued for a massage establishment may be <br /> revoked or suspended by the Chief of Police, after a <br /> hearing conducted pursuant to Section 4-2.1419, in any <br /> case where any employee of the permittee, including but <br /> <br /> <br />
