Mr. Fialho said the General Plan's new concepts for mixed use provide clarity on that intent and that <br /> it is one already embraced in the master planning process. <br /> Vice -Mayor Cook Kallio read from the General Plan that "a major goal of the master plan should be <br /> to foster..." She asked for stronger language, stating that "should be" holds no meaning nor <br /> specifies any intent. <br /> The Council supported the amendment: "A major goal of the master plan should consider transit <br /> oriented development including public open spaces and plazas, and add to downtown vitality." <br /> Councilmember Sullivan voiced support for TODs when they provide a true mixed -use and walk <br /> able community. He voiced concern that rezoning the entire Hacienda Business Park as mixed use <br /> gets away from that concept and raises issues with growth and sustainability. He concurred with <br /> Councilmember McGovern that it would be more appropriate to rezone only the portion of the park <br /> that is centrally located to transit. <br /> Vice -Mayor Cook Kallio questioned whether that change could carry any ramifications. Mr. Roush <br /> said that under the current Housing Element, the city has a commitment to rezone property to <br /> accommodate the remainder of its RENA allocation for the 2009 planning period. This cannot be <br /> done until the General Plan is amended to allow for that use. While a smaller portion of mixed -use <br /> designation would allow for that rezoning, the Housing Element is due for revision. Recent changes <br /> in state law require updated Housing Elements to carry an inventory of property zoned for high <br /> density residential development or else designate spots where that development can occur by right. <br /> Vice -Mayor Cook Kallio questioned and confirmed that the flexibility of mixed -use designation <br /> would allow the city to comply with state law regardless of any intent to develop it as mixed -use. <br /> Mayor Hosterman questioned and confirmed that limiting the mixed -use designation would raise an <br /> opportunity for unintended loss of local control. <br /> Councilmember McGovern reiterated concern that rezoning the entire park mixed -use over and <br /> above the already approved capacity is not something the infrastructure can support. She doubted <br /> that re- designation of the entire business park would be necessary to meet RHNA demands and <br /> cautioned that combined with elimination of the housing cap, it would open one area of town to <br /> intense growth. <br /> Mayor Hosterman said the Council should be capable of shepherding projects that fit well within <br /> that area. <br /> Councilmember McGovern said the public is expecting a business park and that she cannot support <br /> the land use if left as proposed. <br /> Vice -Mayor Cook Kallio acknowledged the expectations of the community in terms of this park. She <br /> said this is a policy document, not something written in stone, and the mixed -use designation does <br /> not automatically provide for high- density development. She stressed that the Council's goal should <br /> be to provide a policy document that reflects what is current in state law while still being mindful of <br /> the commitment to retain this community's character. <br /> Councilmember Sullivan acknowledged the difficulties and asked if the General Plan could be <br /> amended to reflect the necessary units once they are determined by the Housing Element. <br /> Mr. Roush explained that re- designating all or a portion of the business park does not create the <br /> zoning, which is what the HCD looks at with respect to RHNA numbers.
