Staff wanted to have the opportunity to provide Council with <br /> a complete fiscal picture in this situation. <br /> Mr. Wolfe pointed out that the Alviso Adobe Community Park project could not be bid <br /> because it has a current funding shortfall and there are issues in terms of what could legally be <br /> bid for this project in terms of the expected work. <br /> Mr. Thorne suggested that since In -Lieu Park Dedication fees are available, this project <br /> is ready to go to bid. <br /> Ms. McGovern recalled that during the discussion of the dairy lands around the Adobe at <br /> past Council meetings, someone came forward and discussed a plan for development of the <br /> Takens property. She asked if there were plans to develop close to the Alviso Adobe <br /> Community Park? <br /> Mr. Fialho said there are adjacent properties surrounding the Alviso Adobe Community <br /> Park that are slated for development in the current General Plan. <br /> Ms. McGovern asked if development was coming forward for these properties. <br /> Mr. Roush said a preliminary plan for the Austin property has been reviewed at a staff <br /> level. Staff had a number of comments related to the proposal, which are being communicated <br /> to the Austin family. <br /> Mr. Wolfe concurred with Mr. Roush's comments and said the Austin property is located <br /> west of the Ridge and south towards Jorgensen Lane. <br /> Ms. McGovern asked if the development of the Austin property could help support and <br /> fund the development of the Alviso Adobe Community Park? <br /> Mr. Fialho pointed out that the Austin family is required to pay In -Lieu Park Dedication <br /> and Public Facility fees. In the Public Facilities fee roster of projects for which the City is <br /> currently collecting fees, the Alviso Adobe Community Park is a project that utilizes this fee for <br /> financing. <br /> Ms. McGovern asked if the City could impose a condition upon the development of the <br /> Austin property that would require the property owner to pay an amount in addition to the In -Lieu <br /> Park Dedication fees to be applied to the Alviso Adobe Community Park's shortfall. <br /> In the absence of a development agreement, Mr. Roush said the City could not impose a <br /> condition that would require a property owner to pay more in addition to the In -Lieu Park <br /> Dedication fees unless there was something else the City was willing to provide to the property <br /> owner. He noted there have been preliminary discussions about asking the property owner to <br /> dedicate a portion of that property as an enhancement or adjunct to the Alviso Adobe <br /> Community Park. <br /> Ms. McGovern believed the School District Liaison Committee appeared to be interested <br /> in looking at the possibility of the Milking Barn being turned into an active classroom for field trip <br /> purposes. She was not looking to eliminate any component from this project.
