Chapter 9.22 <br /> <br /> RECYCLING <br /> <br />Sections: <br /> <br /> 9.22.010 Purpose and Findings. <br /> 9.22.020 Definitions. <br /> 9.22.030 Permits Required. <br /> 9.22.040 Permit Approval Process. <br /> 9.22.050 Building Permit Required. <br /> 9.22.060 Criteria and Design Standards. <br /> <br />9.22.010 Purpose and Findings. <br /> The City Council finds that: <br /> <br /> A. The adoption of the Recycling Chapter, which will regulate <br />the location and activities of all recycling facilities by <br />conditional use permit, is consistent with the goals and policies <br />of the City of Pleasanton General Plan, in that the City of <br />Pleasanton recognizes the California Beverage Container Recycling <br />and Litter Reduction Act, Assembly Bill 2020, adopted by the <br />California Legislature in September, 1986, to encourage a greater <br />amount of recycling by beverage consumers and a reduction in the <br />amount of container litter in California, and that certain <br />methods of regulating are more appropriate and consistent with <br />the design and aesthetic objectives of the City of Pleasanton; <br /> <br /> B. The Recycling Chapter as proposed would make redemption and <br />recycling of reusable materials convenient to the consumer, <br />thereby reducing litter and increasing the recycling of reusable <br />materials, and would regulate the location and activities of <br />recycling facilities through the adoption of a comprehensive and <br />easily understood program of permitting and regulating such uses~ <br />and <br /> <br /> C. The Recycling Chapter as proposed would not be detrimental <br />to the health, safety and welfare of surrounding residents, the <br />character of the existing neighborhoods or the community as a <br />whole, in that the conditional use permit process provides the <br />City with adequate discretionary control and specific <br />requirements, such as compliance with noise standards and <br />proximity to residential districts. <br /> <br />9.22.020 Definitions. <br /> <br /> The following words and phrases, whenever used in this chapter, <br />shall be construed as hereafter set out, unless it is apparent <br />from the context that they have a different meaning: <br /> <br /> A. "Recyclable material" means material that is reusable, <br />including but not limited to metals, glass, plastic and paper, <br />which are intended for reuse, remanufacture, or reconstitution <br />for the purpose of using the altered form. Recyclable material <br />does not include refuse or hazardous materials, but may include <br /> <br /> - 2 - <br /> <br /> <br />
