ATTACHMENT 1 <br /> AGREEMENT FOR ART WORK <br /> Jill Turman, dba Bella Ironworks, with the City of Pleasanton <br /> THIS AGREEMENT FOR ART WORK "Agreement is made and entered into as of the <br /> 5 day of May, 2009 by and between the CITY OF PLEASANTON, a municipal corporation <br /> "City and Jill Turman, dba Bella Ironworks, "Artist <br /> RECITALS <br /> WHEREAS, City desires to commission and acquire a certain work of art (the "Work <br /> which has been conceived and designed by Jill Turman (the "Artist to be installed on two <br /> exterior portions of the Fire House Arts Center building in Pleasanton, California (the "Site and <br /> WHEREAS, Artist has provided a design for the work and will fabricate it according to the <br /> approved design, and architectural specifications of E.L.S. Architecture and Urban Design (the <br /> "Architect and <br /> WHEREAS, Artist will collaborate with Architect to determine the manner in which the <br /> signage shall be affixed to the building and fabricate the signage accordingly, then deliver it to the <br /> City with tube lighting installed, ready for installation of the Work to the building, and <br /> WHEREAS, the Artist desires to transfer ownership of the Work to City and City desires <br /> to accept ownership of the Work, upon installation and final acceptance thereof by City and full <br /> payment therefore by City. <br /> NOW, THEREFORE, in exchange for mutual consideration, the parties agree as follows: <br /> 1) COMMISSION FOR WORK BY ARTIST. City hereby commissions the Artist and <br /> the Artist hereby accepts the commission and shall design the Work as generally <br /> described in the attached Exhibit A. The Artist shall coordinate and consult with <br /> E.L.S. Architecture and Urban Design, architects for the Firehouse Arts Center, and <br /> their lighting and electrical engineering subcontractors, and O'Connor Construction <br /> Management, Inc. (hereafter "O'Connor who has been retained to oversee the <br /> construction of the Firehouse Arts Center. <br /> A) Fabrication. Upon final acceptance and approval of said Final Design <br /> Documents, Artist shall fabricate the Work, as generally described in Exhibit A, in <br /> consultation with Architect and O'Connor, based on the size specifications of the <br /> drawings. Fabrication shall commence with 90 days' advance notification by the <br /> City, and shall take 45 days to complete depending on Artists' current work <br /> schedule. <br /> 1) Artist will construct signage lettering for both the east and west elevations <br /> which includes supports and access for the lighting tube and the means to <br /> anchor the letters to the building supports provided by W.A.
