EXHIBI~ It~l! <br /> <br /> MODIFICATIONS TO ORDINANCE NO. 1236 <br /> CONDITIONS OF APPROVAL OF PUD-85-15 <br /> <br />1. Modify Condition l(b) to read as follows: "That the common <br /> open areas and areas outside planned grading within custom <br /> lots occupying the "bench" areas be planted in random growth <br /> patterns with 5 and 15 gallon trees (native species) with a <br /> support drip/bubbler irrigation system at the time the first <br /> final map creating residential lots is approved for a portion <br /> of the project westerly of Foothill Road; that after grading, <br /> similar random plantings occur along streets and within lots <br /> in a pattern to be approved at the time of any tentative map <br /> including streets within the "bench" areas; and that Lots 22 <br /> and 23, 26, 52-60, and 63-70 be the last lots in the project <br /> subdivided and offered for sale." <br /> <br />2. Add a new subsection, Condition l(c) to read as follows: <br /> "Final development plans may be approved for phases of the <br /> overall project. Conditions herein which require action to <br /> be done at the time of final development plan approval shall <br /> be interpreted to mean those actions necessary, in the <br /> opinion of the Planning Director, to properly address the <br /> phase of the project proposed." <br /> <br />3. Modify Condition 30 to read as follows: "That, prior to <br /> recordation of the first final map creating residential lots <br /> westerly of Foothill Road, the developer shall offer to sell <br /> to each of the three presently existing homeowners whose lots <br /> abut Lots 31 and 32 on the proposed site plan a 20-foot strip <br /> of land abutting each of the three lots. The 20-foot strips <br /> will be offered for sale by the developer to each of the <br /> three homeowners upon reasonable but mutually acceptable <br /> terms and conditions, including price. If such strips are <br /> accepted, the strips shall be incorporated into the existing <br /> lots and such enlarged lots shall not be allowed to <br /> subdivide. The developer may offer said 20-foot strips <br /> subject to the same conditions at an earlier time upon such <br /> terms as he may wish." <br /> <br /> <br />
