IV. <br /> <br />Construction of Improvements. <br /> <br />A. In the event PG&E facilities precede construction of the roadway <br /> improvements. City. shall ensure that the full roadway rough grading shall <br /> be completed in conjunction with the PG&E project. <br /> <br />B. The City shall fund construction of the roadway improvements and <br /> associated utilities shown in Exhibit M (the "Phase I Improvements). The <br /> City shall make good faith efforts to ensure the timely construction of <br /> these improvements insofar as it is within its power to do so. The intent of <br /> the parties is to have these improvements completed by September 1, <br /> 2003. <br /> <br />C. Phase II and Phase III improvements will be constructed in accordance <br /> with the Specific Plan and conditions of approval. The funding of these <br /> improvements is described in the Finance Plan, a copy of which is <br /> attached as Exhibit N. <br /> <br />Vested Development Approvals. <br /> <br />A. The Property Owner shall be vested with the right to develop the Property <br /> in accordance with and subject to the terms and conditions of the Specific <br /> Plan and existing Project approvals. Without limiting said terms and <br /> conditions, the vested rights include the uses, density and intensity of use, <br /> design of buildings, provisions for dedication of land for public purposes, <br /> and other standards and conditions of development contained in these <br /> existing approvals.
