The City shall require that all new building sites within the Specific Plan <br />area grant to Property Owner an easement for noise, dust. and vibration <br />with regard to Propert?, Owner's quarry operations on County land and <br />that this grant be made prior to the recordation of final maps. The City <br />also shall require that all buyers of parcels subject to the described <br />easement be given a written disclosure with regard to quart3., operations in <br />the area. The City shall incorporate the easement and disclosure <br />requirements in conditions of approval for tentative maps and/or as part of <br />the development agreements with each property owner in the Specific Plma <br />area. The easement shall be in the form attached as Exhibit J. and the <br />disclosure shall be in the form attached as Exhibit K. <br /> <br />Property Owner. at some future point in time. may request that the <br />Detention Basins described in Recital C(4) and Section IIIA(3) and the <br />corresponding easement be modified or eliminated pursuant to the quarry <br />reclamation plan approvals and conditions imposed by Alameda County. <br />The City shall not oppose such a request and shall execute such further <br />documents as may be necessary to implement such approvals and <br />conditions. <br /> <br />The easements for storm drains and outfalls shall be in the form attached <br /> <br />as Exhibit L. <br /> <br />Revision #2 Draft Lonestar California, Inc.
