<br />regional connection fees, in each fiscal year in an amount at least equal to 1.1 tirnes rate <br />covenant debt service in each fiscal year. Rate covenant debt services means: (a) the sum <br />of (1) the district's portion of debt service, on behalf of itself and Pleasanton. on the <br />LA VWMA bonds; plus (2) debt service comprised of installment pa)ments on the DSRSD <br />bonds, and (3) debt service on any parity obligations: less (b) the actual rate stabilization <br />fund draw. See also "Rate Stabilization Fund for Expansion Debt Service." <br /> <br />Regional Agreement <br /> <br />The district provides wastewater treatment and disposal services to Pleasanton pursuant <br />to the agreement for wastewater services, dated November 3, 1992, as amended in 1997 <br />between the district and Pleasanton. The regional agreement generally provides that the <br />district owns and operates the regional treatment and disposal facilities that serve Pleas- <br />anton, while each entity operates its OW11 collection system. Pleasanton and the district <br />have a joint fee schedule, under which regional service charges and regional connection <br />fees are set and administered by the district. Each entity also collects local fees and <br />charges for their respective collection systems. <br /> <br />Implementation Agreement: The district and Pleasant on entered into a financing imple- <br />mentation agreement dated May I, ;2000 in connection with the delivery of the DSRSD <br />variable rate certificates of participation. Under the implementation agreement. the <br />district and Pleasanton: (J) surrender their right to terminate the regional agreernent <br />unless and until the certificates are discharged, (2) agree not to amend the regional <br />agreement so as to materially adversely affect the holders of the certificates. and (3) <br />notwithstanding the regional agreement, funds derived from regional service charges <br />may be used to advance funds to pay expansion project debt service for the wastewater <br />treatment plant. <br /> <br />Wastewater Disposal <br /> <br />LA VWMA was created in 1974 for the purpose of providing for the construction, opera- <br />tion, maintenance. repair and replacement of LA VWMA facilities for wastewater disposal <br />to serve the general plans of Livermore and Pleasanton and the general plans of the planning <br />agencies that DSRSD serves. LA VWMA OW11S. operates. and maintains an export pipeline, <br />pump station. and related facilities for wastewater disposal which benefit DSRSD. Pleas- <br />anton, and Livermore. <br /> <br />Effluent is conveyed through LA VWMA's 16-mile export pipeline (about 4 miles of <br />force main and 12 miles of gravity interceptor) from LA VWMA's export pump station <br />located in Pleasanton to the EBDA pipeline in San Leandro where it is ultimately dis- <br />charged into San Francisco Bay. The system receives and transports treated wastewater <br />from the DSRSD wastewater treatment plant and the Livermore water reclamation plant. <br />The original LA VWMA export pipeline system was constructed in ] 979 and upgraded in <br />1986 to result in a contractual capacity limit of 2] mgd. <br /> <br />LA VWMA is not a rnember ofEBDA. but has a contractual agreement with EBDA for <br />firm disposal capacity right of 19.72 mgd and interruptible capacity of 21.48 mgd as the <br />EBDA capacity allows. for a total right to discharge a capacity of 4 1.2 mgd. <br /> <br />7 <br />
