CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1298 <br /> <br /> AN ORDINANCE DELEGATING CERTAIN POWERS FROM THE HOUSING <br /> AUTHORITY BOARD OF DIRECTORS TO THE HOUSING COMMISSION <br /> <br /> RECITALS <br /> <br /> A. Health and Safety Code Section 34292 permits the <br />board of directors of a housing authority to delegate duties to <br />its housing commission. <br /> <br /> B. At the February 3, 1987 Board of Directors meeting, <br />after reviewing of Staff Report 87:41, the Board directed City <br />staff tO bring the City Council an ordinance to implement <br />selected delegations of authority to the Housing Commission. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Subsection D (Delegation of Authority) of Section <br /> 2.36.020 PMC (Board of Directors) is hereby repealed and <br /> a new subsection D to Section 2.36.020 is added to read <br /> as follows: <br /> <br /> "D. Delegation of Authority. All powers of the board <br /> of directors are delegated to the housing commission <br /> except as reserved in this subsection. The following <br /> actions of the housing commission shall not be final <br /> until reviewed and approved by the board of directors: <br /> <br /> 1. Approval of the annual budget. <br /> 2. Acquisitions of real property. <br /> 3. Issuance of long term debt or bonds. <br /> 4. Appointment of the executive director and legal <br /> counsel for the Authority. <br /> 5. Any other action of the housing commission which is <br /> appealed in accordance with Section 2.36.035." <br /> <br />Section 2. Subsection B (Function) of Section 2.36,030 PMC <br /> (Housing Commission) is hereby repealed. The remaining <br /> subsections are relettered accordingly. <br /> <br />Section 3: Subsection C (Manner of Appointment) of Section <br /> 2.36,030 PMC (Housing Commission) is amended to read as <br /> follows: <br /> <br /> "B. Manner of Appointment. Commission members shall be <br /> appointed by the mayor subject to approval by the city <br /> council." <br /> <br /> <br />
