non-project boundary line or other property line than <br /> will enable fire hazard management measures <br /> satisfactory to the Fire Marshal to be implemented on <br /> lands under the control of the owner and/or homeowners <br /> association. <br /> <br /> 9. The applicant shall receive written permission from the <br /> owner of the parcel immediately to the west (Montgomery <br /> parcel) for all landslide repair and/or grading <br /> on this parcel required by the project improvements <br /> prior to these improvements being shown on a tentative <br /> map. In the event this permission is not received, the <br /> PUD development plan must be modified as necessary <br /> before a tentative map is submitted showing revised <br /> improvements. <br /> <br />10. Access to the westerly (Montgomery) parcel shall be <br /> maintained at all times during construction. The <br /> applicant shall submit a plan to the City showing how <br /> access will be maintained during construction of the <br /> main road for City review and approval prior to the <br /> issuance of a grading permit. <br /> <br />11. The parcel immediately west of the development <br /> (Montgomery parcel) shall be granted an easement over <br /> the Equus Heights subdivision~s streets as necessary to <br /> provide access. This parcel shall be accorded access <br /> without being a party to the project CC&Rts unless the <br /> parcel~s owner wishes to join said association. <br /> <br />12. The applicant shall dedicate across the full project <br /> frontage, at the time of the first final map, right-of- <br /> way along Foothill Road sufficient to accommodate a <br /> four-lane Foothill Road, with median, as described in <br /> the General Plan. This right-of-way shall be based on <br /> the 1972 Foothill Road Precise Alignment, or a more <br /> recently adopted alignment, and should include slope <br /> banks within the right-of-way. <br /> <br />13. The applicant shall construct interim street <br /> improvements on Foothill Road to the satisfaction of <br /> the City Engineer to effect safe ingress and egress for <br /> the development. These improvements shall include left <br /> turn, acceleration, and deceleration lanes as generally <br /> shown in the development plan but with shoulders added <br /> to Foothill Road south of Muirwood Drive. Project <br /> streets should be designed to meet Foothill Road at the <br /> ultimate right-of-way width, with interim improvements <br /> to connect to the existing Foothill Road. <br /> <br />14. The applicant shall enter into a deferred improvement <br /> agreement with the City for the construction of <br /> frontage improvements from right-of-way to and <br /> <br />(as revised at the 2/8/89 Planning Commission Meeting) <br /> -2- <br /> <br /> <br />
