11. [S418] Subdivision of Parcels <br /> <br /> No parcel in the Project Area, including any <br />parcel retained by a participant, shall be subdivided with- <br />out the approval of the Agency. <br /> <br /> 12. [S419] Minor VariatiOn~ <br /> <br /> Under exceptional circumstances, the Agency <br />is authorized to permit a variation from the limits, <br />restrictions and controls established by this Plan. In <br />order to permit such variation, the Agency must determine <br />that: <br /> <br /> a. The application of certain provisions <br /> of this Plan would result in practical <br /> difficulties or unnecessary hardships <br /> inconsistent with the general purpose <br /> and intent of this Plan; <br /> <br /> b. There are exceptional circumstances or <br /> conditions applicable to the property <br /> or to the intended development of the <br /> property which do not apply generally <br /> to other properties having the same <br /> standards, restrictions and controls; <br /> <br /> c. Permitting a variation will not be <br /> materially detrimental to the public <br /> welfare or injurious to property or <br /> improvements in the area; and <br /> <br /> d. Permitting a variation will not be con- <br /> trary to the objectives of this Plan or <br /> of the General Plan of the City. <br /> <br /> No variation shall be granted which changes <br />a basic land use or which permits other than a minor depar- <br />ture from the provisions of this Plan. In permitting any <br />such variation, the Agency shall impose such conditions as <br />are necessary to protect the public peace, health, safety or <br />welfare and to assure compliance with the purposes of this <br />Plan. Any variation permitted by the Agency hereunder shall <br />not supersede any other approval required under City codes <br />and ordinances. <br /> <br /> D.
