Such determinations <br /> shall be made in writing and a record shall be kept <br /> in the office of the department of building <br /> inspection which record shall be available to <br /> interested parties. <br /> <br /> 20.16,050 Variances. <br /> <br /> The director of building inspection shall have <br />the power to grant a variance to any of the <br />provisions of the adopted Uniform Mechanical Code <br />upon application in writing by the affected party <br />or his duly authorized agent, when there are <br />practical difficulties in the way of carrying out <br />the strict letter of the Code, provided that the <br />spirit of the Code shall be observed, public <br />health, safety and welfare secured, and substantial <br />justice done. The particulars of such variance and <br />the decision of the director of building inspection <br />shall be entered in the records of the building <br />inspection department of the city and a signed copy <br />furnished the applicant. The granting of any <br />variance shall not be construed to imply or fix any <br />liability on the part of the city or any officer or <br />employee thereof for any damages to persons or <br />property by reason of such variance. <br /> <br /> 20.16,060 Appeals. <br /> <br /> Whenever the director of building inspection <br />shall disapprove an application or refuse to grant <br />a permit applied for, or when it is claimed that <br />the provisions of the Code or this chapter do not <br />apply or that the true intent or meaning of the <br />Code have been misconstrued or wrongly interpreted, <br />the applicant may appeal from the decision of the <br />director of building inspection to the city manager <br />of the city within thirty days from the date of the <br />decision appealed. Such appeal shall be in writing <br />and the city manager shall within thirty days of <br />the receipt of the appeal and by written notice to <br />the appellant either uphold, reverse, or modify the <br />decision of the director of public works. The <br />decision of the city manager may be appealed within <br />thirty days of said decision to the board of <br />appeals established by Section 20.16.070 of this <br />chapter. <br /> <br />20.16.070 Board of appeals - Established. <br /> <br /> There is created and established a board of <br />appeals consisting of five members.
