CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1386 <br /> <br /> AN ORDINANCEAPPROVINGTHEAPPLICATION OF BAS HOMES <br /> FOR A MAJOR MODIFICATION TO PUD-83-12 REGARDING <br /> CONSTRUCTION OF FENCES ON LOTS 7, 11, 14, 15, AND <br /> 19 OF TRACT 5445 (PUD-83-12-5M) <br /> <br />WHEREAS, in March, 1984, Council approved PUD-83-12, a <br /> 19-lot residential development at Mohr Avenue and <br /> Martin Avenue; and <br /> <br />WHEREAS, bas Homes has applied for a major modification to <br /> an approved development plan for an existing <br /> residential project to allow six foot fences to be <br /> constructed within seven feet of the property line <br /> on the street side of corner lots located on Lots <br /> 7, 11, 14, 15, and 19 of Tract 5445 on Martin <br /> Avenue; and <br /> <br />WHEREAS, the Planning Commission has recommended approval of <br /> the major modification subject to certain <br /> conditions; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Approves the application of bas Homes for a major <br /> modification to an approved development plan for an <br /> existing residential project to allow six foot <br /> fences to be constructed within seven feet of the <br /> property line on the street side of corner lots <br /> located on Lots 7, 11, 14, 15, and 19 of tract 5445 <br /> on Martin Avenue, subject to the following <br /> conditions: <br /> <br /> 1. That 6 foot fences may be constructed on Lots <br /> 7, 11, 14, 15, and 19 of Tract 5445 within the <br /> 25 foot street side yard setback, as shown on <br /> Exhibit A (dated May 9, 1988), upon approval <br /> by the Planning Director of the following: <br /> <br /> a. The design of the fence to be installed <br /> along the street side yard of each <br /> individual lot; <br /> <br /> b. The landscape plan for the street side <br /> yard of each individual lot; and, <br /> <br /> <br />
