be reserved for lower income households for a period of <br />fifteen (15) years. <br /> <br /> HUD regulations for the qualification of households <br />as lower-income, the size of unit in relation to <br />household size, and all other rules and regulations <br />except for rent shall govern those units set aside for <br />lower income households. Affordable rents for units <br />designated for lower income households shall be <br />charged. <br /> <br /> For purposes of this chapter and with respect to <br />any one bedroom unit, affordable rent means a monthly <br />rent which does not exceed thirty percent (30%) of <br />one-twelfth (1/12th) of the maximum household income at <br />which a household of two people qualify as a low income <br />household as stated in this subsection. For purposes of <br />this chapter and with respect to any two bedroom unit, <br />affordable rent means a monthly rent which does not <br />exceed thirty percent (30%) of one-twelfth (1/12th) of <br />the maximum household income at which a household of <br />four persons would qualify as a low income household <br />within the meaning of this subsection. <br /> <br /> Units designated.for lower income households shall <br />be of comparable size and quality as other units in the <br />project. <br /> <br /> Developer will be required to provide an Annual <br />Compliance Statement and enter into a growth management <br />agreement which shall be recorded with the County <br />Recorder and run with the land. <br /> <br /> Projects meeting the above stated criteria are <br />eligible to request exemption from the growth management <br />development approval process and to use the units set <br />aside for such projects. The City Council may approve <br />lower income housing projects up to the number of units <br />in the set aside. A project which includes both lower <br />income units and market rate units shall be approved in <br />its entirety. <br /> <br /> Eligible projects shall be those meeting the <br />criteria contained in P.M.C. Section 17.36,150. The <br />City Council, in its discretion, may choose to review a <br />lower income project application based upon existing <br />approved plans or other governmental approvals if it <br />feels sufficient information exists for it to review the <br />applicant's eligibility. <br /> <br /> Application for lower income housing projects shall <br />be submitted on a form as required by the Director of <br />Planning and Community Development. Additional <br />information may also be required by either the City <br /> <br /> <br />
